Would me entereing into an IVA help

Hi,

I am in a difficult situation whereby my husband and I have both separated and we had a verbal agreement that he will take over all the debt and pay it, and keep the house. Subsequently, he entered into an IVA where he had half of our unsecured loan written off. The full loan amount was £27916.25 and he is paying half of that back over over 5 years, with the other half written off. The mortgage company (Northern rock) are now claiming the full amount from me, and speaking to a solicitor, there is nothing I can do, I will have to pay it, even though I cannot afford it. They have issued a CCJ against me and not him, as he is protected by the IVA. Northern rock have not informed me of any proceedings against me, even though they have my new address, and the claim form did not reach my new address. What do I do? Would me entereing into an IVA help as well? Please could you advise me what to do.

Unfortunatley with the joints debts you will still be chased for the amounts outstanding, not sure if an IVA will be suitable for you you would be better to talk to an IP.

Sorry to hear that Sharon. I know it's no help now but methinks your husband's IP should have been aware the NR debt was a joint one
