Been in our iva for nearly two years when we completed our 1st year review we were told no additional payments were due from me as i work part time as a nurse and that i never work over time just various shifts which can be more or less at the end of each month. And that due to working for the nhs none of the extra money earned from shifts would be included, we have a new IP and have just
done this years review to be told that this has all changed and I have now had a bill for £1, 067.00 in addtional payments to be paid . worried sick. As there is no way i can afford this in 14 days waht could my options be please.
Hi Jayne - welcome to the forum. Do you have the 10 / 50 / 50% clause in your IVA? Have you exceeded 10% in some months?
If so, then their decision is probably right. I've not heard of NHS additional payments not being included in the IVA calculation before. Is this in your IVA proposal? If so then I would query this with your IP.
If you agree with the additional income calculations, then I think you'll have to speak to your IP about maybe adding it onto the end of the IVA if you cannot pay it over a few months.
Our proposal states we must tell our IP as soon as we are aware we have received over 10% of our normal net pay. I must admit I prefer paying it as it happens as it is easy to dip into the money.
I am a nurse and whilst my extra earned from weekend work etc was not included in my income as it is not guaranteed, I did have t the 10/50/50 clause so only pay over this amount. Speak to your ip and see what your options are x
I'm a nurse too and have never heard of an NHS exemption! I have the 10% 50'50 clause which means my IVA payment is based on my basic salary only, I also don't work any overtime but do get enhancements which vary month to month, I am allowed to keep 10% extra above my base salary and then split the rest 50/50 into the IVA.
It sounds like someone made a mistake, what does it say about extra income in your proposal? does it say anything in there about an exemption? if not then your IP will have reviewed your proposal and then calculated this sum owing from your previous earnings.
I would hazard a guess that they will be more than happy to allow you to pay this sum back over a period of time rather than in the next 14 days, give them a ring tomorrow to discuss this
Ask you IP if you can pay this amount over time from your share of any overtime etc, or ask if your IVA can be extended by a two or three months to cover the amount due.

I suspect that a bad turn of phrase may have been employed here, and as it is nobodys best interests to jeopardise your IVA I can only echo the advice that you should work through this with your IP.
As a matter of interest, was your proposal based more on "bank" work rather than regular shifts as most people would know them? As someone with a good lady in the NHS I would be most interested to find out.
