God I am so sorry this has happened to you.
I kept looking on here to see the outcome of your meeting, but thought that maybe they had come to their senses and just given you a warning (for what, but hey!).
It is a shame that they couldn't have even offered you a different position in the company - maybe one where it was not so directly in contact with money etc - but it sounds like they were determined to keep to their rules, and not give that human approach to the situation.
It is also a shame that while we are protected by law against the creditors, that we are not protected against companies like this.
i agree that they have to have their rules/conditions etc - but it is not like you are ignoring your debts, you are making the sensible decision to do something about it.
i wish you all the best, and I'm sure a few months down the line you will be able to look back with your head held high.

What a sad story.. I'd heard a few stories about ING to be fair... My friends work there in Reading and there have been a few stories of similar style things :o(

I know it doesn't really help but finger's x'd for you that something sorts itself out. Life can be such a b!tch sometimes but it's how we recover from each little challenge. You'll be fine (easy for me to say). Hope everything does work out

Hi Sue,

Since you first post about this I have kept my eyes peeled for an update and I really didn't want it to be this I am so sorry this has happened to you and whilst you certainly don't feel like it at the moment a few months down the line you will glad that they did it. Sometimes we need someting like this to reassess our lives, careers and where we are going in life.

Please concentrat on yourself and not the debts. In the grand schem of things they are pretty insignificant (even though they might not feel like it)

Please keep your chin up and head held high and i appreciate its not easy but try to stay positive. Don't forget if you are feeling blue log in and tell us - we'll support you and try to cheer you up!!!

Oh Sue, I'm so sorry, I feel saddened by your story. Try to keep your chin up, and remember that your health is far more important than any of this. You are better out of a company like that, you deserve better !

Thanks everyone. I have asked them for a copy of my personnel file. I also asked them for a copy of the recording that was made. They are quite happy for mt to have the personnel file I just need to write in they seem less happy for me to have a copy of the recording.

Does any one know if I'm allowed to have a copy of the recording that was made at the disciplinary hearing. I have the notes but that obviously doesn't show the badgering tone.

Hi Sue

I would expect that under the data protection rules you would be afforded a copy of electronic amd hard copy data. I assume that if they recorded it it is now in electronic form therefore you should be allowed a coopy.

I am really sorry to hear about your news as it seems really irrisponsible of an employer to do this type of thing.

Good to post the information here so people can vote with their feet. either now or in the future people can now decide if they want to support a company such as this by saving or investing with them.

Hi, being new to the forum, although a keen reader for weeks, I have read your post with interest. I am an empoyment law specialist and feel compelled to offer you some advice. What we generally find is that irrespective of the law some employers choose to do whatever they like, they will only have a problem with that if the employee takes them to task on their unfairness and in reality many choose not to as it can be time consuming and complex. Your employer may feel that because it states in your contract that you should advise them of debts etc. they have a right to dismiss you, however in law they would have to show that whilst the reason for dismissing you was a fair one under the terms of your employment contract they also have to show that the action they took was reasonable. I would suggest that this is the area that you could challenge them on.
Did they look to see if there were other available roles you could have done if they thought that you having an IVA was unsatisfactory in the position you were in? Did they consider your health position in taking this action? they were not advised fully of your situation due to your health? this could be mitigatng circumstances.
It would be interesting to hear the grounds for your dismissal and their justification, which they have to give in writing.
With regards to the recordings made at the meeting I would suggest that although it specifically does not come under the Data Protection act. the principles of natural justice make clear that you should be entitled to consider any 'evidence' they had or used in making their decision and presumably they did not make an immediate decision at the meeting suggesting they listened back to the recording prior to their decision? Have a look at your home contents insurance if you are considering fighting the decision, many have provisions for civil claim representation cover and as employment legislation falls within this category you may be able to get representation free. Also you need to appeal the decision with your employer if challenging this is the route you wish to take or at least advise them of your intention to appeal once you have all the documentation etc.
