I have spoken with payplan today we went through an I&E review and we are £100 a month short of out planned payment. Payplan told me the IVA was in risk of being cancelled if I cannot make the repayment. Dont know what to do?? I also mentioned the possibility of a full and final settlement. They agreed to helping me put this to my creditors, we have repaid just over half out debt(3 1/2 of 5 years) I have no idea of what amount would be acceptable to them?

Why can't Payplan suggest a reduction in payments for you for goodness sake? They should not be talking of your IVA failing, but trying to help you adapt it to a more comfortable level. How much do you feel you can now afford to pay to creditors on a monthly basis?

Thats what I thought! I have agreed to try and reduce our housekeeping witch to be fair is over the recommended amount. They have not included DLA we receive so we can cover the extra £100. This still leaves me in the same position as a when I started, wanting to give the family as enjoyable life as possible. There is nothing in our budget to allow us to do this, other than the remaining DLA which is supposed to help with added living costs.

This seems very harsh especially from a firm promoted and funded by the banks. They should be moving heaven and earth to help you and not causing extra stress!

Payplan as a whole have been great, I have a new case officer, we had a lengthy conversation, she did not seem too forthcoming with a solution other than, 'the IP will need to know why you cant make the repayment, you need to reduce outgoings somewhere or they will have no option but end the agreement'.I do have a few areas where we spend over the reccomended, but that is down to the fact we are a family of 6+2 teenage sons who visit every regularly. I was happy for the IP to see my situation for what it is and make a decision. I have now agreed to try and reducing more in the areas we are over budget, but dont know if it is do-able, will have to see come the end of the month. I feel like ive done full circle, but not got anywhere. thanks for you replies.

I suggest that this new case office arranges an urgent meeting for you with the IP over the telephone as soon as possible, as it strikes me that you now need advice from the very person who is responsible and qualified to provide same.

An offer of payments to date to enable you to enjoy your time with your family seems a logical one to me...hopefully you'll get a meeting with your IP who is best placed to advise.
IVA final payment left the bank on the 26th January 2013...looking forward to a debt free future.

Hi All,

Our IP has asked me to state:
"Supervisors can only act on the facts of a case supported by evidence and that in certain circumstances creditors want to see some of the evidence on which decisions are made."

Looking through the notes of the case, I can see that we (the Case Officer) have requested the evidence and once received will be taking the file and case to the Insolvency Practitioner.

It is regrettable that these circumstances have befallen you MNJ6, but rest assured we will act as quickly as possible once the evidence required has been received.

Well hopefully the evidence which is required by this IP can be provided very quickly, and then the IP can review matters equally as quickly given the very sensitive nature of the issues concerned here.
