Good evening everyone
I have been on the forum before, so will briefly outline our problem. We have an IVA with Synergi, our supervisor was Karen Potts who has now left and we have been appointed 2 new supervisors, a Ms Sue Watts and a Mr Gordon Saker. We had some difficulty nearly two years ago with our payments. My husband lost his job etc. To cut a long story short there was no communication from Synergi for about 18 months and in that time we made no payments. We tried consistently to speak to Synergi but to no avail and they never returned our calls. Last November it was agreed between us that we would go through all our debts again and a variation meeting would be arranged. The meeting was scheduled for 3rd April. I rang Synergi yesterday to be told that the meeting had been adjourned, for what reason it has not been made clear. We had agreed that we would keep in regular contact by email as our mail seems to go adrift. We were not contacted to say the meeting had been adjourned. I have tried yesterday and today to speak to Synergi. I eventually spoke to Sue Watts who left me very distressed as she told me in no uncertain terms that the debts were our fault and we would have to suffer the consequences. Our problem has been made worse because we have about 20 debts and I discovered yesterday that several of the debts have been bought by Maxx recovery and they have voted to reject the variation, which at the moment means that they have a large percentage of the vote. We dont own our own property and my husband is self employed so we dont want to go bankrupt.
Any advice would be greatly appreciated because we gave Synergi the benefit of the doubt when we decided to let them continue with our IVA, now we are getting in even deeper water and we dont know what to do.

Well she sounds like the caring sharing side of our profession doesn't she! It amazes me that people with that sort of attitude actually want to work in this profession, let alone qualify and hold a licence to practice as an IP!

I suggest that you await the outcome of the adjourned meeting to see if the rejecting votes can be outvoted. If not, then you may have to consider bankrutpcy or debt management as a better way forward.

Hi Debbie

Welcome to the forum, this forum has seen some bad posts about synergi. I am so sorry that this chosen route to try to address your problem has met with such a pityful display but it doesnt suprise me with this company. I just cannot see the justification to blame you like this when youre clearly trying to address the problem and they are getting paid to help you, not to blame you. They should hang their heads in shame, not you. They clearly dont care but will willingly take money for a service they dont appear to deliver. How these people are allowed to continue is beyond me, its sad for the debtor and good IPs and gives the IVA industry a bad name.

I really wish you the very best of luck with this. You are amongst friends here who will want to give help and support, unlike your chosen IVA company.

Whilst from what you say it's probably too much to ask for, has your IP told you why Eversheds (who will have voted on behalf of Max) have voted to reject?

Hi Ian
I cannot get any information at all. I was promised a phone call yesterday and as they were open until 8pm I expected this to happen...stupid me...I am under the doctor for stress as it is and Ms Watts had me in tears earlier in the day. I am being passed from pillar to post. I have the Managing Directors name and have left a message for him but all to no avail. We received a letter today saying that the meeting of 3rd April had been adjourned til the 17th April, there was no more information. I suggested to Ms Watts that I should phone Maxx recovery and she said "carry on".

We genuinely now feel that because we are in such a state, Synergi are making matters worse. Companies have bought up our debts and for instance Maxx recovery now has quite a chunk of our debt, therefore having a significant say in the voting.

My husband works away all week and is only home at weekends and I am desperately trying to deal with this by myself, but I just cannot get any sense out of Synergi.

We know only too well that we have made mistakes but I did not expect Ms Watts, our appointed Supervisor to be so nasty as to keep pointing out that we only have ourselves to blame.

I can perfectly understand why people are so depressed when they are in this situation. We are wishing that we had never dealt with Synergi and we certainly hope that other people entering into an IVA steer well clear of SYNERGI!!

So in conclusion We know nothing, are being told zilch and are getting desperate.

I would normally say that Eversheds involvement is a good thing. I will be happy to have a word with them for you to try to find out what the problem is and, importantly, whether it can be fixed. If you want me to do it you will have to include an authority otherwise they will not be entitled to speak to me.

I managed with a struggle to speak to Andrew Walker at Synergi..he has been off sick for a couple of days. I have given him until 6pm this evening to answer my questions as he is supposedly going to talk to Eversheds this afternoon. He was adamant that I was not to speak to them!! We will await this outcome and no doubt we will be taking you up on your kind offer. I have also complained to him about the way our Supervisor is treating us and he said he could not comment as he did not hear the conversation. I suggested that he listen to the recordings as they make a point of saying when you ring that this conversation is being recorded. He told me that that he was not sure if they are recorded or not!!

I ended my conversation with him by saying that I would like some sort of contact by 6pm this evening even if it was only to say that he was still waiting for answers, its easy to email I said!! His answer to that was why would he contact me. I was so gobsmacked that I said, "well it wasnt to know what you had for lunch today ", I felt he had an obligation to keep us informed!!

Lets hope we hear something by 6pm.

Hi Just an aside, if you tell them that youre recording every conversation, just in case they dont, you might get different answers.

Hi Sue
Thank you for taking the time to write to me.

Did they call me.....surprise surprise no but I did get a email just before 5pm. I now have an up to date list of our creditors and a list of the companys that have bought our debts. A big problem now is that they have sent me a text of what they are saying to creditors and the reasons why no payment has been made for nearly 2 years, and surprise surprise again, they have not mentioned that they have been to blame as well. I will be on the phone again tomorrow.

Watch this space!!

Hi again Ian

Surprise, they emailed me around 5pm, so I now have a list of creditors and the companys that are buying up the debts.

They sent me a text of a letter that they have sent to creditors to explain what is happening and to re-consider their votes. I will be making another call tomorrow because the content is not true and they havent even admitted that there are errors on their side as well.

They specifically said that I was not to speak to Max recovery or anyone else as we could then ruin what they are trying to do!!

We are getting so frustrated. Maybe we are wrong in expecting to see what they are writing about us, but seeing as there have been so many mistakes, we feel it is so important to be upfront and tell the truth.

I will keep you updated.
