With the majority of people who regularly post on this site - who are in geniune need of advice and support, I too wish there was a way of vetting posters who continue to attempt to bring the forum and the opinions of professionals into disrepute. The law is the law - like it or not. Debt is Debt - we (the debtors)accepted the loans and credit etc and we have a moral obligation to pay as much as we can back to these lenders, no matter how difficult it is, but within reason so as not to "kill" ourselves in the process. Creditors still appreciate the fact that we have to live.

Again, accept the roller coaster, pay the 50% and be debt free in 5 years!!!

Right, I too will jump off my soap box!!

Maybe admin can clear this up for me as there seems to be 2 versions of BigPete on this thread. I seem to remember a Bigpete from March this year who was in Scotland and doing a Trust Deed. He was ex forces and had a few discussions with Melanie. Are these 2 different posters from the same IP address?

I didn't see his deleted post but it seems odd he would be linked to anything adverse towards this forum when he received such support when he needed it and then supported others in Scotland after that.

I agree with sadsack,nobody twists our arm up our back to spend money we couldn't afford, even if it is the right thing for the wrong reasons.
If i was owed money i would want it back.
Unfortunately, i don't get paid for overtime at my main job, that is why i took on a second job pre iva.

If one is made redundant (whilst in an IVA), do you have to loose 50% of the redundancy payout?
Also, if one retires, do you loose 50% of the tax free lump sum?

I may have been guilty of assuming that you were posting with a hidden agenda and, if I was wrong, my apologies.

But given the nature of your first post, followed up by the second which intended to flag the "shortcomings" of the IVA process, haven't you already made up your mind that it's a procedure that isn't right for you?

Hi scj58 and welcome to the forum

This depends upon the express terms of your IVA, so if this is likely to happen to you, I would get out the documents and have a read of the small print.

Redundancy money is generally used to replace lost income, so this is unlikely to be touched unless you get another job before the funds have been exhausted, and pension funds are largely excluded now from all insolvency proceedings.

Dare I say it Melanie, but I smell a with rat with csj58's post. Again I may have to eat humble pie but this post is typical of the type that I was referring to, and why post on this thread?
