Right...that's better, I understand now. Sounds like they have just realised their mistake and are trying to get out of it and trying to get money out of you at the same time.

This debt is automatically a debt within your bankruptcy (doesn't matter whether you are discharged or not - or as Ian says it is probably statute barred.

I suggest that you send them a copy of the bankruptcy order and advise them to liaise with the OR directly.

I'm still waiting for a reply to my email. If they turn round and say I owe them money I'll refer it to the OR, but if they are happy to just cancel the service (if it's still working) I'll leave it at that.

I used to get an email from them each month saying my statement was ready but I couldn't open them as I didn't have a pin number. I tried to request one but never got it. This is the first thing I have received through the post since I had the phone disconnected.

Hi Tracey, Thanks for contacting Virgin Media about cancelling your television services.

We?re really sorry to hear you?re cancelling your television services with us. We hope you weren?t unhappy with our service, but if you were we?d like to know about it. We?ll do all we can to put things right.

But if you do decide to leave us, we?ve taken care of the disconnection for you. The services have been disconnected with immediate effect.

If you require any further assistance, please contact Staff Accounts Team on 0800 *** ****, option 1 between 8.00am and 6.30pm. Or just replyback to the same email -- I'll be happy to help.

It's obviously a standard reply (they're still as useless as ever!) as it doesn't refer to my original email at any point. I'm not going to worry about it now - I can't pass it to the OR as the bill says I'm in credit, and Virgin haven't said that I owe anything. If I get a bill I'll pass it onto the OR and take it from there.

Seems as if it's sorted in the usual impersonal, no-blame accepting way these companies do.(I used to work at a large mail order company who also had finance going on the side!!!) As long as you no longer have the service, that's the main thing.

Hopefully it's the last I hear from them, but it's good to know that if they do demand money I'm only liable from 29th March last year to today as the rest is caught up in my BR.

Skippy I don't think you are liable at all.

The contract passed to the OR on the making of the Bankruptcy Order. it is then for Virgin to accept cancellation of the contract (which they appear to have done) or they could require the OR to disclaim it.

You are only liable for any payments if you had used the service after your bankruptcy. I note that the account is shown to be in credit, so by the same token if you get a refund I'm afraid that will belong to the OR [:)]

So if I get a refund for the 66p they say they owe me do I seriously have to get Dave to write me a cheque for 66p?!?!?

Does that also mean that the OR owns my Vodafone contract? If so, what happens after I'm bankrupt, does it revert back to me? I never actually mentioned that I had a contract with Vodafone as I didn't owe them any money and when I asked the OR if I could keep my mobile they said yes.

I can't see anyone getting hot under the collar about 66p.

The principle is the same with your Vodafone contract too. Technically the contract vests in the Official Receiver who has the power to disclaim it. If you use it after the Bankruptcy Order then clearly you have to pay for such use.

With both of these cases, there is the materiality and practicality issue. If you had owed each of them several hundred £s then you would have drawn them to the attention of the OR who would then have taken steps to cancel them (question- do the contracts provide for termination anyway on bankruptcy?). As you don't owe either of them anything then it all becomes a bit theoretical.

I've got no idea about Virgin as I never signed a contract!

I think the Vodafone contract does say that they can terminate the contract if I go BR, but I rang and told them. They asked if there was anything they could do to for me and I asked if I could switch to a lower tariff (I shouldn't have been able to as it was less than 6 months since I'd changed previously) and they did this and threw in free text messages!

Mr. Wen here... O2 still sponsor ARSENAL (that's how it's spelt [;)]) and I find it highly amusing that Mrs. wen has an O2 contract (not that she realises where her money is going) [:D][:D][:D]

I can't bring myself to type it! I definitely won't be getting an O2 contract now, or flying via Emirates (like I can afford that!)!

On a serious note, I hope Eduardo recovers from that awful injury. I saw the pictures and it made me feel sick.

Arsenal have released a statement saying he could be playing again in nine months, so fingers crossed there, it is his 25th birthday today too poor guy! The photos were bad enough, but I saw on Sky Sports News a graphic earlier of the actual break in motion and it was truely stomach-turning. [V]

I find the whole Wenger bashing in the media even after the retraction of his comments a bit harsh, especially as i'm sure old Alex would have been just as scathing if not worse, if it had been Ronaldo or Rooney!
