Official complaint about creditor harassment ?

I'm still being harrased for a debt included in my IVA and the creditor is still adding costs/interest. I have informed them in writing on at least 10 occasions now that I have an IVA inplace. Can I make an official complaint against them. My IVA provider has been useless as well and appears to have made to effort to resolve the situation even though I've asked them to. Your advice would be greatly appreciated as I'm starting to feel as down as I was this time last year.

Hi and welcome to the forum.

You can write to the Information Comissioner I believe (correct me someone if I am wrong) and complain about the harrasment. It should not be happening.

However, rest assured that the interest and charges are irrelevant and cannot be added. I presume this creditor was included in the IVA?

Which IP company are you with?

Hi, The creditor was included in the IVA. My IP company is Payplan. Lost count of the number of times my case manager has changed in the last 12 months [:(]

Hi, I would suggest you contact you case officer as soon as you can and tell them. They should be able to contact your creditors and tell them to stop. Let me know how you get on.

It is a criminal and civil offence to harrass a debtor and your IP should be able to point you in the right direction of how to take this further. Forget about case managers if they are changing with the tides and demand to speak to your IP. You pay their wages and have an obligation to talk to you otherwise you could go to their regulators and complain.

It is not good enough that you are being tortured after the IVA has been approved and your IP should sort this out.

Thanks for your replies.

I have just posted a letter to my creditor advising once again that I have an IVA in place and that I am seeking legal advice regarding harrasment. I have copied this letter to Payplan and also informed them that if they do not sort the situation out (have already asked them to do this in writing on several occassions) I will be contacting the Financial Ombudsman. This situation has been going on for nearly 12 months now, I have a stack of letters I have sent to both my creditor and Payplan asking them to liase with each other and have got nowhere. I'm beginning to wish I'd gone bankrupt instead of the IVA route. Payplan have been useless (endless changes in case manager and no responses to my letters)and I never once thought I'd still feel like crap one year on from my IVA approval! [V]
