Well I sent the email on thursday I believe. On friday when I rang the office and spoke with them the lady on the phone said oh yes she received the email that I sent to the IP. Needless to say I wasn't too amused. Monday will soon be here though. I will call again and see what they have to say. I will also send in a new expenditure form. The only thing is will I have to send in 2 expenditure forms. One as if I was staying in my current situation and another as if I was moving out.

Or do I just stop making payments and move out. I have seen the posts on finding a place to rent while in an IVA. 6 times rent as a deposit through an agency. I will have to definitly find a private landlord. This will most definitly reduce what I pay at the present moment though.

I would not do anything until you sort things out with the IP, or a member of his senior staff who can give you proper advice.

Well the advice I was given so far was to find a place to rent and fill out a new expenditure form and send it in. So this is what I will do in the meantime. I will continue calling until I can speak directly with my IP.
Thank you so much for all of your advice

Hi guys Im back. Im still waiting on a payment from the student loans company but they say it can take 2-3 weeks. So I am patiently waiting.

I have been working out a few figures. My IP sent me a letter for an offer of full and final about three months ago when he said £15,000.

At the end of this month I would have paid back a further £1215

When I calculated the remaining amounts I would have to pay. I have 24 months left 12 at £476 and the remaining 12 at £652

That leaves me with a final figure of £13536 in actual repayments.

Am I being fair offering a figure of £13000 as a Full & Final

I think you are being more than fair and you could probably offer less. Speak to your Supervisor (IP) and see what he/she thinks!

Thanks guys I will get in touch with him this week. My family have sorted the part they are going to give me + the extra to make up the difference. Im just waiting on the Student Loans Company to send me the money. Then I am all ready.

Mr Mond I have never had the chance to speak to my IP. Just his underlings. I get everything sent to me by letter and everything goes through them. I will attempt to get through again this week. I just want a swift resolution to it all.

Good Afternoon everyone. I hope all is well with everyone on a snowy monday.

*Just a quick update*

I am amazedat how the student loans company have managed to operate thus far. I still haven't received the cheques that they said they would send me. So I rang them a while ago. Only to be told that the cheques have been processed but not sent out as yet. I will be required to wait another 1-2 weeks. Ive been waiting 3 weeks already.

My next move was to contact my IP office which I have done to let them know what is happening. To keep them in the loop. Only to be told oh we have received that money already (Thanks for letting me know) approx £2800. From the past 3 months when my IP offered to put forward the £15000 I have now paid a further £1215.

Am I correct in saying that the IP would look at that as me paying off £4015 towards the £15000 that he agreed to put forward to my creditors.

My review is up this month so I have kindly asked them to try and arrange the F&F alongside this. Funnily enough I didnt get as much grief as I got the last time I rang them. They have said that they will send me another figure this week. I just hope its achieveable and not ridiculuous.

They are very slow in restoring payments to clients after an IVA has been accepted - and what we generally do is let our clients pay a lower amount until this is sorted out, and then the Student Loans company pay us the equivalent of the contributions they have incorrectly deducted which is paid back into the IVA fund.

These monies surely have to be treated as part of your contributions, but you will need to check that with them to be sure.

Cheers Melanie. That has what has happened the the Student loans company has paid the money that the iva should have been receiving for the past three years.

My Ip sent a letter which said that they would put an offer forward of £15K I have paid off £4015 since this time with the student loans contribution + my normal payments for the last three months. So I am just waiting now to see if they revise the F&F or whether they come back and say we will accept £15K.

I should find out this week. So fingers toes and ears crossed it will all go well.

Thank you all for all your help to date. Its much appreciated.

The monies received by your IP will be treated as part of your contributions so don't worry. Glad the matter appears resolved.
