oh so we had black horse on phone today, giving us there u cant do iva we wont let you, you must arange a debt managmnet plan with us or we gona go to court to apply for certificate of earnings form, you cant do and iva as we wont freeze interst and you payments go up n up nnot down, we then asked as we been told to ask them to remove work contacts number of file she said no, basical they were saying that if we agree to there terms they contact all our creditors for free and get them to agree this. as if we were gona pay and IP we could pay them. so now im worried that they defo gona refsuse IVA and then if the thing come through b4 meeting we gona end up in court cause of it, Ip tried to reasure me that it take more than 2 week to get a court to approve them to get cert of earning credit meeting on 14th,but now im worried what if IVa fail casue we refused on there terms they gona take us to court aint they and then what are we going to do, arah im so worried again, DFD said that 95% pass, but i just think we be in the 5% that dont.
and im so scared as to what happens next, as the last thing we want is to go to court, or get our work places involved, god 2 weeks 2day to meeting n im a wreck she got to me so much today i nearly said oh go on then do it your way, which IP said is wat they wanted, same way they get payments from you. DFD said i could ask for work tel numbers to be removed seems as they causing probs for my husband atwork i mean if he gets sack no 1 gets paid, she sadi point blank NO i wont remove the numbers and im starting application for earning cert asap, i was so upset so i rang BH head office and gotthe number for complaints, they have now taken mine and husband swork numbers off as they have a home and mob number. i just hope thid dot make things worse,can they get worse, sorry to waffle lisaxx

just to recap i have 13 creditors owing 19 n a bit thousnad Ip sugested 49 p in the ound is that a good figure?

First dont worry, its scare tactics, you are trying to pay what you can afford via IVA and the courts will be able to see that, it will cost to take you to court and there has to be a good reason, Black Horse do not have one, so dont worry about that. Did you go with the first company? Your debts are quite low for IVA. Another thing, they are not allowed to cause distress and it seems to me that they are, by threatening something which they cannot do at this time. If they call again mention the telecommunications harrassment laws. I am sure there will be an answer for you lisa, do not allow these bullies to do this to you.

5700 we owe BH morw than i thought oh god that aint good is it but saying that DFD keepsaying that if Bh refuse it they aint got enough of the debt

lisa my main problems were with BH, they threatened me with all kinds of action all the way through for 9 months and didn't do anything, they don;t want to incur more costs to themselves, today i received a nasty letter off them threatening baillifs again,i telephoned them to inform them i am now BR and the man started to stutter, revenge felt sweet for once, i am not proud that i am BR but i did everything possible and they were the ones who put up the biggest defense, as lily says there will be away forward for you, BH phoned me at work once and i told them if they did it again i would lose my job and then no one would benefit, they never phoned again.

so if for some reason my IVA get accepted can they still contact me for payment, not sure i ca cope, and another thing she said was that they wont freeze interest on my account, so my debts wont decree they just go up and up

once your iva has been accepted they will have to deal with your ip, as the agreement is legally binding, as long as you keep your payments up they won't hassle you, i also found once they knew when the creditors meeting was going to be i never heard off any creditor for 2 weeks, don't worry you will be fine.

Black Horse have a policy of rejecting all IVA proposals where the debt is more than £7,500 or is less than one year old. If your circumstances are outside of these benchmarks, then you ought to stand a good chance of acceptance, but Black Horse do hold more thab 25% of the overall vote, so a yes vote from them is crucial.

oh great there we go then, they not gona acept it , we dont owe them over 7,500and the debt is just a yr old may swel give up now why have DFD gone ahead with it knowing that they gona refuse it n said to us they cant say no n if every 1 else says yeah it will go ahead may be we should have gone ahead with wat they said 2day fed up now

Lisa dont panic Melanie said they refuse if the debt is more than 7500 and you owe less than that and you say the debt is a year old then that is not less than a year. Try not to worry you have done the best that you can and ther will be a solution regardless. Fingers and everything crossed for you.

You may have misunderstood my post. Your debt is under the £7,500 figure and is over a year old, so you fit into the "possibly acceptable" category. I am sure that your IP would not have put an IVA forward for you if they felt that there was a real chance of rejection.

hi melanie sorry if my post sounded abrupt thank you for your answer it just with her saying today your not going to do and iva we wont let u im worried sick, u no todays the 1st day since b4 we gotto the iva i have been physicaly sick i though id got over that but one call from them n bang im back to square 1 stressing and being sick, doc said i need to be careful hes worried, if have to go back hes puting me on anti depressants. i dont want that yet today i feel like running away again thanks for your help on here

I know its easier said than done but you need to calm down and let the professionals you chose to work for you. You cannot do anymore than you have done and if you keep allowing BH to stress you out, youre going to make yourself ill with it all.

What ever happens at the creditors meeting there will be a way out of this debt for you, you have already come so far, take a deep breath and try to think of all the positive steps you have taken to address your problem. Its out of your hands now and you can do no more. Your IP will want this to be succesful also and has put a lot of effort into it for you.
