Aaah - a breath of fresh air and hope at last!!!

Please, please try and put some sense into the people at Black Horse of the merits of IVAs in the right circumstances, and the need to look at each case on the basis of individual problems and not just with a "it doesn't fit the criteria" model.

I look forward to meeting you on a professional basis shortly (I wonder if I know you already?) and please post on the forum anything relating to Black Horse policy, especially if it is likely to change in the near future.

Oh Don't worry Melanie, If I can get it through to them I will!!!

I don't think I have met you to be honest Melanie...I am currently working at DebtMatters and previously for Debt Free Direct.

As soon as I know anything about Black Horse I will let you know. I start on 12th March so hopefully after that you will start getting some positive votes back from them!

Both of you thank you very much for all you help again and yes I think my IP will do their utmost as they don't want me to be forking out an extra £50 per month which is what AmEx think I should be paying and living on fresh air! As Melanie says, I think it is about time that someone human should work in the collection departments of creditors like Black Horse! I don't think there are many people who get into debt just for the fun of it (I certainly am not one of them).

May not sleep much tonite but do feel a lot better.

Thank you once again and will keep posting and will be more upbeat about things! (well I will try!!)

I feel for you Stella,why oh why do creditors not bother voting ???
Can you imagine the difference if a non vote equalled a yes vote.It would wake a few creditors up !!
If creditors did not vote and it was deemed a yes vote then the need for an adjournment would disapear,costs would decrease and worry for the debtor reduce.
One day maybe !!

Hello everyone

Hope you don't mind me asking another question regarding this non voting thing. Could the fact that Barclaycard and Lloyds TSB voted for my husband and not me just for a bit of tactical voting (i.e.could be rejected or adjourned), or is it just my proposal is a bit further back down the line than my husband's? I know it sounds silly but thanks in anticipation.

Had my adjournment but yet again had to be adjourned till next Monday because of no votes from Barclaycard or Lloyds TSB for me. I really do not know what's going on, I contacted both companies direct who are both adamant they have not received my proposals, it's v strange, can anyone shed any light on this, I know it's probably only admin but if they are saying they have not received my proposals how are they going to manage to vote by Monday with all the other IVA proposals. My IP said they have been chasing up the votes, so where are they?

Feel like I am back to square one yet again, lots more tears and another set of contact lenses ruined and I had the day off specially.

Oh no stella, I am sorry. I afraid, i am unable to help with the question, I dont know why. Its a real bummer for you though. I know all about the contact lens thing though, same here.

Hang on in there, easier said than done I know. I remember gariboraky, (something like that) was in the same boat and sick of it, it all went through in the end though.

Thanks Lily,

Just had a look at gaborkirali's postings, yep v v similar. At least I know we all suffer from the same troubles (even contact lenses!). Even my husband cried when he came home from work today and he never cries. Still we got ourselves in this mess, we have to get out of it and am trying so dam hard to do it the right way!

Get your IP to fax/e-mail those proposals to both creditors directly tomorrow and then confirm to you that this has been done and that the banks confirm receipt. You are at risk of running out of time here if not careful.

Hi everyone,

Yes Melanie I have asked my IP to do that, as I spoke to Barclaycard directly who seemed to be very helpful and even gave me a fax number and told me to get my IP to fax the proposal over and they would deal with it when I explained my predicament. Something definitely gone awry here. I am not going to fork out an extra £50 per month for Am Ex just because of an administrative error that need not have happened in the first place. Thank you once again.

Hi,

My IVA prop has been faxed to Barclaycard, so all we can do is wait. If they and anyone else who didn't vote at the creditors meeting and on Monday just gone (1st adjournment date) still don't vote by Monday which is the second adjournment date, what happens then? Does the original voting still stand, as although the IVA could have gone through, it was adjourned because we wanted to outvote AmEx because they wanted an extra £50 per month more and 25% of any further pay rises. Can I arrange another IVA due to non voters, or would I have to go down the inevitable route? Any help would be much appreciated..
