My husband and I are thinking of entering an IVA but my husband is in the Navy and I am a nurse in the NHS, will this affect our jobs? Secondly what are the chances of losing our home which has about £1000 equity, not even that probably? We are both quite well paid but we have over committed on credit so are now in a situation where we owe more than we earn. We have worked out that we could afford about 60-70p/£ do you think this will be accepted (understandbly I know its individual circumstances) but am now worried as our major creditors are HSBC and MBNA. Can anyone help?

Hello

You would need to consult the terms and conditions of your employment contracts but on the face of it I would say that both your jobs are very unlikely to be affected by an IVA. We have but through many successful cases for both Nurses and people in the Armed forces.

In an IVA you would NOT lose ownership of your house. You may have to release any equity you have amassed over the term of your IVA but this seems unlikely given the information you provided.

You are quite right, an IVA is individual and you will have to pay back as much as you can to your creditors over the term of your IVA. I believe that you have a strong chance of successfully proposing an IVA and would recommend that you contact several companies and discuss this further with them.

No. The Armed Forces generally have a very dim view of bankruptcy proceedings, so an IVA is usually more favourable. The NHS don't really have a policy as such. I have acted for many serving members of the Forces, and NHS, quite successfully over the last 10 years.

Your home is not an issue, but be prepared to offer an extra few payments at the end of the IVA to take into account the equity.
