Hi Annemarie

Can I ask whether you own a property and whether you know if the Supervisor has asked to be appointed as the Trustee?

Over the weekend get straight in your mind what you are going to say to the District Judge i.e How you ended up in this position and how you propose to rectify it.

I have only had one letter in the last month from the IP company. I understand from an article in the press that they are winding up that side of their business, so it may be that they cannot be bothered with
me. I thought they would have sent me a statement outlining what they had done to date, how much money they had given to the creditors, and the outcome of the last creditors meeting.I waited week after week for that.I feel like the biggest idiot to have waited.
I wrote to their solicitor and he said that I should ask them direct for any information I require. Then on the 14th of February I got a 5 line letter telling me the followin: I had paid £15.125.00 and that the arears to date were £5.250.00,I trust this information is sufficient for your purposes. I then wrote back and thanked them for that information and offerrd £20k.

The court hearing is on the 27th. so I do have time to get a solicitor. I had kept hoping to this last minute that they would accept my offer.
It is now looking as though they have not.

If they have not answered your letter of offer then that must give the court cause to question whether an adjournment should be granted. Just be open and honest with the judge.

Even if a Bankruptcy Order is made on Monday, don't worry, that doesn't mean it's the end of the matter.

The Court are unlikely to make an Order if you attend and there is some hint of a dispute. In my experience, the Judge will usually err on the side of the debtor - at least at the first application for adjournment, but I would make sure that you take all of your papers with you relating to the offers of settlement you have made.

I realsie that one is not supposed to advertise ones services here on the forum but you are up against it and you need someone in your corner on monday. Only cost is you buy the coffee!

I don't think that there is a problem with you assisting someone on a free basis - and well done to you for stepping in to help. If you do go, make sure that you post the results.

Thank you Paul for your kind offer. I have not asked anyone to be with me in court as I was waiting until Monday in hope that I might hear if the offer was accepted.
The hearing is on Thursday morning so there is still a little time left. The court is Southampton County Court. I would be glad to speak to you on the phone.

I have the file ready and we will see what the post brings on Monday.

Thank you Debbie, Ian, Melanie and Paul for your support over the last week.
I sat in this office ever hopeful that I would get replies in writing or by telephone, to the correspondance sent to the IVA Supervisor or her solicitor, but that was not to be.

I am so sad to be going to court tomorrow, especially as I now have an updated statement from my accountant which shows several incorrect amounts, thus reducing what she believes the overall debt to under £10k. In her statement she states that she has copies of correspondance she has sent demonstrating this, over a period of 2 years, with no replies.
My sister has emailed me a leter: TO WHOM IT MAY CONCERN, confirming that she will guarantee any payment agreed and approved by my accountant
I did try so hard to save the day.
Thank you all again, this Forum has given me more assistance than I could have ever imagined, I will let you know the outcome tomorrow.

Paul and I have discussed your case on the telephone today and have a few pointers of our own which I know he will be speaking to you about tomorrow!
