Can I add one other creditor to my IVA, I have been in it for 18months?

Hi slt and welcome to the forum

Only with the agreement of the other creditors - which would need to be sought at a specially convened meeting, and also the consent of the omitted creditor. Be prepared to have to extend the term of the IVA to effect the original dividend payment.

Hi Melanie

Thanks for repling. I have sent the details to my IP and spoke to their office yesterday and they advised it should be ok as is for a small amount and the term is already over 5 years. Do you think this wll still be ok?

If the new [missed] creditor does not affect the dividend proposed by more than 10%,once included,am I right in saying that a creditors meeting is not needed ?
Or does it vary from IVA to IVA ?

It does depend upon the terms of the IVA Andy - but the provision you quote is much commonly used these days. Additional payments may have to be made in order to pay the dividend achieved if this was guaranteed - or a minimum dividend was stipulated under the terms of the proposal.

Hi, I have the same query, I am in an IVA since the start of this month. But genuinly missed a debt for £1500. I gave my IVA company details of this debt at the start, but missed the fact that they hadn't put it on my IVA. There is no minimum dividend clause in my agreement, and the total debt was for £23,000 so how will this affect me?. I am paying 26/£ in my IVA (lucky!), but think with some care in the finances, I can afford extra in my monthly payment which at 1500 at 26/£ return should be £6.52 over 60 months.

Worried all over again now.
