Hi Melanie, thanks for your advice, I would go and see her but last time I went as I said before all she kept saying to me was I think you should throw the towel in. I don't think at this moment I am strong enough to go and see her. I do feel so much better after your and Ian advice but all I keep thinking about its Friday tomorrow and you always seem to get bad news on friday, will I come home to a letter from the solicitor. I hope not.

I am saddened that you feel that you cannot approach your IP as you find her intimidating, when she should be giving you support and advice. What you need to do is keep up with the payments for the next year and tell her that "throwing in the towel" is not your style and that you intend to honour your commitments.

Thanks Melanie, I will definitely keep up my payments. Must admit I have never had any support from my supervisor - there are a few stories I could tell you.

Have a lovely weekend in Dublin and I will keep you up to date.

If you need company and some moral support on the trip to the supervisor I am always keen to show my face so keep the offer in the back of your mind just incase.

Hi, I hope someone can give me some advice. I have just heard from my supervisor today who is still hoping to make me bankrupt. Her letter said that she has heard from her solicitors who have told her she is not yet in a position to proceed with bankrupcty. She is now calling a meeting with the creditors to ask them to go with her and file for bankrutcy. She has told me I can submit any variations to the creditors within the next 14 days. Can I go to the meeting and does anyone think that would be a good idea? I suffer from high blood pressure and last week at the doctors is was high again, to be truthful I don't think I can take much more of this. I will get the sack if I am made bankrupt so the creditors won't get anything as my husband would not be able to pay the mortgage. Any advice would be helpful thanks.

Hi Dawn

really sorry that this is not sorted yet and that it is getting more stressful. It is quite limiting in the forum to give advice when we don't have the full picture etc. But what we can all clearly see is that you are trying to meet the obligations of the IVA and want to gove it a go.

I would however recommend that you take the time to get on the phone and get some FREE impartial advice and start looking at plan B just incase plan A doesn't work.

Nothing like a lack of understanding to frighten one to death. Some knowledge is always very helpful and may actually give you some peace of mind.

Incidentally has the Supervisor put himself down to be a trustee in Bankruptcy? Also is there any equity in your home?

Hi Paul, I don't know if she has put herself down as trustee. We have got a £180,000 mortgage and my husband put down £120,000 from the sale of his house which he wants back if I am made bankrupt, our house is worth £320,000 - £330,000 so there is only about £30,000 at the most which we will have to half. If I get made bankrupt I will get the sack and the house will be repossessed which I have told her. I just cannot understand why she is being such a nasty person. Dawn

My investigations indicate that your IP is not a partner in this practice, so maybe you ought to lodge a formal complaint about the treatment you are receiving with the Managing Partner (who is also an insolvency practitioner) and ask him to look into the matter for you.

Perhaps it would be worth contacting Paul Johns, to provide him with more facts and allowing him to make a call on your behalf.

Thanks Melanie, I think she is an associate she told me that she has been doing this for 20 years. I will speak to Paul. I was thinking of making a complaint but I didn't want to make things worse. I have a few other things as well to complain about like before my IVA was approved I asked her about my bank account but she told me that the bank would would be ok but when the IVA was approved they closed it down on the day. She got very nasty when I asked her to get mine and my husband wages back. There are other things as well. Do you know if I would be able to go the creditors meeting? Regards Dawn

Hi Paul, I have been told that the company I work for would not be happy, nor would my husband. No my hubsand is not in the IVA it is just me and my husband was not happy that I had got myself in all this debt without telling him. Dawn
