I shouldnt worry too much because if the creditors accept your offer the cost of the meeting would be drawn from the ammount you are offering.

I have heard back from Payplan I am very impressed with their response to my letters, I have received responses back near on straight away, i have my creditors meeting set for the 4th March lets hope all goes well. They have said i don't have to attend, many of my creditors didn't even bother voting for my IVA, but 75% of my debt did, does the same apply or do thye have to all agree to the full and final ??

The 75% vote is still needed but i shouldnt worry too much, you are making a good offer and i dont think you will have problems getting it accepted.

Hi

Just to clarify the voting rules - it's 75% in value of those creditors who take the trouble to vote. Those who do not vote are deemed to have gone along with the decision of those that do.

Thats interseting

So if you offer a full and final settlement, this will only be accepted if 75% vote yes, Just like when first entering an IVA.

Does that mean if any creditor does not vote, this is taken as a yes vote.

Do creditors vote the sames way for a full and final settlement As when you first go in to an IVA.

For example if some creditors did not vote when i went in to the IVA, does that mean their would be a good chance they would not vote if i offered a fianl and full settlement?

I can only go on my hubbys personal experience but those that didnt vote at the beginning also didnt bother to vote on the F&F offer.
I dont suppose anybody knows the answer to that one.

Hi me again, my meeting is 4th march and Payplan are now phoning me asking me all sorts of questions, apparently my creditors have sold my debts to another compnay they want to know if i ihave a partner that can pay and if i am returning to work and when, I will have childcare to pay even if i did return to work, I have siad if they don't accept my offer i will have to go bankrupt i was really optimistic now i am not so sure, it is a measly debt the ones that are aksing aso many questions ?? I am not sure they will accept my offer now, can i still go bankrupt ??

Wait for the outcome of the meeting, they could very well be outvoted anyway. Dont worry, cross bridges as and when you come to them.

Hope your pregnancy is going well and glad scan was ok

I wish you luck for the 4th march, I am sure your cirrcumstances will be taken into account and creditors will realise its a good deal.

Don't stress out too much as you have a little one on board now to worry about[:)]
Be positive & look after yourself, there are more important things in life than debts....
