Mortgage - I have recently split from my wife with whom I have a mortgage with for a property in negative equity. I am currently living in the property and my ex wife has agreed that I can keep the house and is happy in principal to 'sign' the house over to me. I am aware that there is next to no chance that my lender will allow me to take on sole responsibility of the mortgage however is there any way that we could get some sort of letter from a solicitor signed by us both that will be legally binding in that she no longer has any right to any future equity and can not make me sell the house.

Many thanks

IVA final payment left the bank on the 26th January 2013...looking forward to a debt free future.

Hi ashleymstone,

Sorry to read of your separation. Yes, you can get a Deed of Trust put in place. Ensure the correct wording is in place to clarify the restrictions and limitations on your ex-wife. Seek legal advice for help with this and you will both have to sign the document. Let us know how you get on.
