Additional debt?

have seen before instances where a debt has been sold on and the IP has added this as a new debt in error, alongside the old debt, when they are, in reality, one and the same --- make sure they are not doing this here.

I was reading this forum & I have a horrible feeling this is what’s happened to me- I had a letter last year advising me that I had an additional debt from MAX Recovery that had come to light after 3.5 years of paying into my IVA-the money was an additional 4K. I was so worried about it stopping my IVa altogether at the time that I didn’t question it properly, but my IVa was made up of unsecured loans & credit card debts, all of which I knew of. Is this something I can look into further now I am armed with a bit more knowledge or do I have to suck it up now it has been added to my IVa? (An additional 12 months of payments was agreed by my creditors upon a meeting about it)?

There is no reason why you should not investigate this now -- you may well get the extra 12 months rescinded !

Now any ideas where I start with it?
Would my IVA people be the best people to start with or do I have to prove it was a sold on debt? All very confusing

Have a look at the debts listed in the IVA and see if any match by amount, or any other details. Then ask the IP, addressing your concerns, stating that you do not recognise this debt as yours and ask what checks they have carried out to verify the debt.

1/2 way through my IVA I was informed of Additional Debt, I refused to acknowledge the debt as mine in a letter to my IP as I did not recognise the creditor or the amount. Turns out it was an included debt that had been sold and bought a few times, last one to buy it found out I was in an IVA and submitted it to my company. Didn't take long for GT to realise their mistake and rectify it once I questioned it.
Last Payment made 04/12/14. Completion Certificate 25/7/15. IVA company GT. No Issues

I was quite ill last year on and off so I didn’t think to question it properly at the time (my fault I know)- but I have this morning phoned the number I found for Max Recovery & spoke to a helpful lady who confirmed the original debts refer to 2 creditors who were already listed on my original IvA. I’m going to contact Creditfix this afternoon by phone initially and see how I get on-wish me luck! Thanks for all your advice!

Thanks Merlin! They were a bit wishywashy on the phone to me, but I’m going to dig out my paperwork to back up my point-they are going to get back to me apparently within 2 weeks so I shall ensure I am forearmed!
