Have to say with Payplan - within 2 weeks for both me and hubby, we were off. I know others take longer but it should not longer than 3 months.

I received a reply!

"Details of the IVA record entry will stay visible on the IIR Register for a period of three months from the date of update/notification (18/08/2017) to The Insolvency Service. Ideally your IVA record should omit off the IIR Register on the 18th November 2017. The IIR Register is legislative requirement and a automated system which we have no control over."

So, despite my IVA being completed on August 4th they did not alter their records until the 18th. The three months kicks in from the date they update their records and NOT the completion of the IVA.

They make it up as they go along -- as for automated and they have no control over it .... sounds like them telling me names were not coming off when we could all see they were !

It is 3 months from the date they receive your completion details - it won't be long now.

Hi

IVA Closed in 2016.
DFD went into administration and now my name is still on the Insolvency Register however, if you go into this the STATUS is showing completed 11th November 2016. But name still on there.

I have also complained to Aperture Debt Solutions whom has taken over DFD because they still have restriction on my Land Registry. Can this be removed?

I would take this up with the Insolvency Service.They have been informed of the completion, otherwise it wouldn't have been marked completed in the status.

Restriction can be dealt with by way of RX3 (see LR Practice guide 35, section 7.4.4:-

"7.7.4 Cancellation of the restriction

Where the restriction is no longer required and the proprietor can produce evidence to satisfy the registrar of this, they may apply to cancel the restriction.

This might be where the restriction was entered to protect an interest that no longer applies or to ensure compliance with obligations that have already been fulfilled. Alternatively, the proprietor may be able to show that the restriction was to protect an interest that is adequately protected by another entry in the register. The application must be made in form RX3 and be accompanied by evidence to satisfy the registrar that the restriction is no longer required (rule 97 of the Land Registration Rules 2003). If the restriction relates to an interest that vested in the Crown on dissolution of the company, the application should be accompanied by evidence of the dissolution and may require the support of the Treasury Solicitor (or the Solicitor to the Duchy of Lancaster or Cornwall)."

So happy. Now it feels like a line has been drawn under the past (almost) seven years.

Looks like it is automated as I can't imagine someone would go in and remove us on a Saturday morning.

Annoying it is three months from the day they update their records and not from the day of completion. I think this is flawed.

The whole Insolvency Service is flawed / superfluous / spineless / I would say "not fit for purpose", but I am at a loss as to what that "pupose" might be !
