Hi I hope you can help me. My IVA completed in June 2016 and I am building my credit score but Santander keep sending me yearly account balance letters stating the balance outstanding despite the account being in an IVA. My concern is that my mail could be opened by someone and it's embarrassing plus surely they should have writtten this debt off. Also M&S still have on their records I have account with them despite it being in the IVA. They are not chasing me but surely I can tell them to stop sending these statements it's my past. Can you advise me please. When I called they said it's still live on their internal records etc
Write to their data controller with a copy of your completion papers asking them to remove your details and close any "live" accounts as the data they hold in incorrect. You can get details of the Data Controller from the ICO.
