Will my wife's iva affect my ILR application? I am on spouse visa.

After entering uk on spouse visa in 2013 i got leave to remain permission in sept 2016. Now i will be applying for ILR in feb 2019. My wife met accident last year and her business started going into red. She is in debt and want to enter an arrangements with banks and credit cards firms. Will this arrangement affect my ilr application?

The arrangement shouldn't affect your application however you will need to check the position regarding her income --- to sponsor a spousal visa she needed to earn a wage in excess of around £18,500 .... I do not know whether this applies to your subsequent applications.

Thank you for a very prompt reply by Foggy to my question relating to effect of IVA arrangements of my sponsor,my wife on my ILR application next year. In one of his posts he advises not to mix the partners income in iva arrangements. But m and s people sent us the income and expenditure form where we are supposed to write the total income of both.how we can deny that.

2nd response:
Thank you Foggy for the prompt reply to my earlier question regarding effect of my spouse IVA arrangements on my ILR application. In that reply you mentioned that my wife must be earning more than 18,600 per annum. Fair. She is earning 12600 while i am earning 9000 per annum. If we enter into joint IVA arrangements,will it be ok

Shahid, I am afraid this is really a question for the Visa Authorities to respond to, regarding income limits. Regarding the IVA: If you are both entering IVA's, they will, most likely, be interlocking, so both incomes will be treated as one and you will make one payment for both the IVA's. If only your wife is entering the IVA, usually, they will want to know your income only to work out the correct share of household expenses. However, at least one firm I know of will use both incomes towards one IVA (they use household income to work out the payment, not just that of the insolvent partner).
