I already have an IVA with DFD, been on suspension for a few months due to council tax arrears. We are still in debt with the council, previous pay day loans, water company, HMRC and a catalogue DFD wouldn't include at the time. We are broke, we run out of money the day we get paid. We have to borrow from family and friends to buy food...we are desperate. We both work, have two school aged children but we can't go on anymore. My husband is an Accountant, bankruptcy would destroy his career and we would be worse off...can we ask DFD to 'rejig' our IVA and include the debts we have aside from?

Hi,

You need to speak to DFD urgently to try and get this sorted as it sounds as though your payments are way too high.

You need to be careful with HMRC as they may try and make you bankrupt.

How long has the IVA been going on for? Why didn't they include the catalogue debt.

All of your unsecured loans should be included in the IVA -- why did DFD do this ?

That apart, yes, you can ask for your I&E to be recalculated as you are probably not getting the correct allowances.
My opinions are merely that .. opinions based on experience. Always seek professional advice.

I don't understand why some creditors were not included in the IVA - this does not sound right.

Are you sure you are in an IVA and not perhaps a DMP?
