I posted around 1 month ago re GT spotty letter i had received in feb this year basically saying i had to sign & return a form re ppi claims or GT wouldn't complete my IVA, i had to stop paying my IVA after 2 years in feb 2012 due to having an accident, I had to leave work due to this & told GT then that i wanted to go BR, my mum paid a solicitor to take care of all the paperwork etc & they would go to court on my behalf so i wouldn't have to, i've been suffering with bad depression, am in constant pain & on medication & seeing a counsellor since june 2012,i'm on esa benefit & my health is really suffering because of all this.Mel told me to go to court anyway & the judge may issue the BR without the completion cert from GT but i contacted my solicitor & they say they can't go forward with anything until GT close my IVA, i don't know what to do or what way to turn, can anyone help/advise me? I have so little faith in GT i don't want to e-mail Karol who does post here.[:(]
There is nothing in legislation that prevents you from filing for bankruptcy if you have an IVA in place, although many Courts will insist on seeing a Termination Certificate. If you have the money available, why not give it a try - you have nothing to lose as no money will be taken from you if the application cannot proceed - and if you tell the judge about the background of your case they may well be sympathetic. Alternatively, you could pop into your local County Court and have a chat with the bankruptcy clerk, who could guide you about the procedure in that particular jurisdiction.
