Hi All , back in august a claims management advised me i could claim back my ppi from the bank.recently i recieved a letter back from them stating it was succesfull and have been invoiced for nearly 3000 pounds. i never recieved an offer from the bank until 2 weeks ago offering 1499 pounds which i havent signed agreeing too.i have 6 months left on my iva and dont understand how i can be charged for something i havent declared agreeing too.

yeah i asked claims advisory group to investigate,i wasnt advised if i was in an iva i wouldnt get a penny and be invoiced by the claims group.they said any fees would be taken from total ppi recieved.my iva is with grant thornton.ive not signed anything from the bank for their offer.

Yout really need to get some legal advse on this carl maybe from CAB??, have you spoken to GT about it to see how much was payed in and how, there mkust have been a conversation betweek your PPI claimers and GT if the money went straight to them?!?!? You should really have spoken with them prior to claiming back the PPI. Any agreement to investigate will also include them to claim it on youre behalf if there are monies owed due to mis selling of the PPI

Any amount you got from anything such as PPI etc are classed as windfalls and all payable into an IVA, this will be in your original paperwok prior to the IVA being approved.

This is the danger of reclaiming ppi during an IVA,as the claims company may end up out of pocket as your creditors just reduce your debt by whatever amount of ppi reclaim you are due to get,but then the ppi reclaim company want paid as well!!!

Wasnt that the aurgument put forward in favour for signing the Power of Attoney, it makes the IVA firm resposible for claiming and paying any fees.

Hasnt there been a few previous posters who have done this and been loaded with claim firms fees ? - after all there out to make money, not to explain the consquence of claiming PPI during an IVA

If there is any PPI to claim, surely it is for the debtor to claim it and pay it over to the IP. If it is the IPs duty to maximise the dividend why on earth are they willing to lose 25% to an outfit who are doing little more than writing one or two letters. After all, we know that the banks are no longer contesting claims.

And, if there is no claim to be made ... drop it.

Think that the trouble !! - these firms make is sound so easy - just fill this form in and they do all the work (at a cost)!! - and of course when the PPI cheque goes straight to the IP or offset into a creditors account - the claim firm wants paid !!!

Said before - i be glad went this "bandwagon is finish with" or the banks start to question the claims !!!

Hi all , thanks for all the replies. im under the impression the claims firm are stumped as they say i need to sign the declaration from the bank so they can get their invoice money.is it true if i dont sign the declaration i havent officially claimed from the bank.
