If this was correct,why would the letters state that these first 2 cheque payments of £393 would be my first & second payments into the agreement & the s/o for £569 states this would be my third payment into the iva.

Hi. Fees are generally drawn from the "IVA pot", so the money to cover them would correctly be described as payments into the IVA. The problem here, of course, is that, at the time of making these payments, there was no IVA to pay into.
I will not comment further as Size% is looking into it for you. I hope you come to a mutually agreeable solution.
