What happens to money awarded after a car crash ?

Hi, I recently had a car crash in which I was injured. The solicitor is trying to get £2000 plus expenses. What would happen with this money with our IVA. Would it be taken from me?

Hi Nicola, I was in a car crash nearly 3 years ago and the injury side has not been settled yet. Although in our proposal the injury claim money was listed as protected our creditors are allowing me to keep anything upto £5000 but the rest has to go into the IVA. What does your proposal state? Check with your IP and see what they say. Hope you are ok after the crash.

Hi Nicola,

Any sum awarded for pain and suffering is normally excluded from the IVA windfall provision. I would speak to your IP to make sure this is the case in your IVA.

And make sure your solicitor gets a breakdown of the award to show how much is for pain and suffering as not too many 3rd party awards are broken down - it's normally just a lump sum offered.
