Sorry ive not posted for sometime but i have been looking in. I mentioned in my last post that my hubby was diagnosed with kidney cancer - well he had his operation and the cancer was removed successfully and he made a good recovery - he has a scan next week to check all is well etc - these he will have every 6 months for the next 2 years.
Anyway - its now a year since we completed our IVA - god the time has flown by! - We've both checked our credit reports through Experian - still being defaulted by some creditors and amounts still showing - including Max recovery. Hopefully that will change after the 11th May as that was the date out IVA started in 2005.
Anyway - Has anyone had dealings with Max recovery?? I have received 3 letters from them regarding 3 of my creditors - all showing outstanding amounts. All of these creditors were included in the IVA. I called them and explained that the IVA was completed last year, it is also showing on my credit report as being completed and i have the certificate of completion. They told me they have not been made aware that my IVA is completed and that the monies are still outstanding and owed!!! The chap on the phone said that he knew i was in an IVA with DFD but as far as they are concerned its still outstanding!!! Should this be happening?
No it shouldn't!!!! A sharp letter to their complaints department is in order - enclose your certificate and threaten them that if they don't update their records and remove any post-iva defaults within 28 days you'll go direct to the ombudsman. It really angers me to hear about companies behaving so badly. P.S. Most importantly, congrats on your husband's recovery. That's amazing news xx
So pleased your husband is doing well Jen, that's great news.
You need to write to Max Recovery enclosing a copy of your certificate and tell them to remove anything negative posted after the start date of your IVA. Give them 28 days in which to do it otherwise you will take it further.

Both mine and hubbys credit reports still show some creditors defaulting with outstanding amounts showing - should these start to drop off after May 11th(6 years after IVA started)? Some other creditors we had have completly disappeared from the report.
If the defaults are prior to the IVA being agreed then they will drop off, if afterwards it will obviously take a bit longer. If they are still defaulting then you need to get the defaults removed.

Yep - the ones that are left on there are all still defaulting and there are still amounts of money showing too. How do we go about sorting this out. Do we contact the creditors?
Jen as Jan posted above you need to send a copy of your completion letter to Max Recovery giving them 28 days to remove all detrimental entries post acceptance to the IVA from your record or you will go to the financial Ombudsman.

thanks as always Declan. I'm going to look in on my report after the 11th may to see if anything has changed - thats when the 6 years will be finally up. If nothing has changed i am going to contact Max again - if i get the same response i will indeed contact you. I cant understand why they are still defaulting me and there are amounts owing still showing on there. I found it odd that they knew about the IVA and these 3 creditors were included but still this chap insited that i still owed the money!! perhaps he was a new guy. I'm not too concerned as i have no intention of applying for any credit - i was curious to see what was on there really after i received those 3 letters.
No worries Jen - you know where I am if you need anything. I do find it very strange myself and maybe you are right in that this chap is new but it doesn’t excuse this type of activity.
