Hi all.
I agreed a full and final which was accepted 2 years ago and I decided to register with Experian to keep a close eye on my credit report. It's pricey but the best thing that I've done.

I have received an alert notification as I did last year at the same time, for TTI SPC - Freemans by any other name - stating that I owe them money, even though they had the settlement in 2009.

I know I can't cancel the account information, but I've been working pretty hard at tring to get my report in a good place and have recently gone up to "FAIR" from "don't even bother" !! This change is going to shove it right back down again.

I have asked Experian to chase it again and add a notification of dispute to my records, but is there any way I can stop these people from doing it again next year ?

I seem to be taking a couple of steps forward on repairing my credit file and then get thrown back a mile. [:(!]

joh71262 - welcome to the forum.

you doing the right thing - a notification of correction.

I personally would send a strongly worded letter direct letter (to senior management)recorded delivery, asking how can they account for the debt, clearly disputing the debt,and reasons for this. It is up to Freemans to prove this.

If they get a collection agency involved - then again dispute debt with the agency - Again it is up to the agency to prove debt and they need to put the account on hold and recheck their information.


Was the debt incorparated into the IVA ??? - if it was a copy of your completeion certificate - Freemans would have been bound by the IVA.

Any defaults post IVA acceptance have to be removed so just write to the Data Controller at Freemans and tell them to remove the entry.

Some of them do try it on don't they?

The debt was incorporated into the IVA and they received their F&F in June 2009. I suspect it's something to do with Year End financials but they shouldn't keep re-activating it as outstanding.

Is there any legal action I can threaten them with to stop it once and for all ?

Try a strongly worded letter - directly to senior management- advising the debt was dealt with under the IVA. As as they are bound by the IVA - the debt is now concluded. However suggest they undate their records. You expect no further communication from them and request removal of all incorrect personal data from their data files

I would certainly tell them where to get off! They cannot keep chasing you for a debt that doesn't exist anymore. A very strongly worded letter to their data controller with the threat that you will take it further if they don't remove any adverse entries on your record will hopefully do the trick.

It never seizes to amaze me what these creditors try. Some people who struggle to understand letters and sort things out would just pay it as they panic. This is how creditors make there money I am sure.
