hi i have posted before but things have changed alot!!

we are real danger of failing our iva that we cannot afford 10 months in!

we owe 102000 and the iva paying £40000 i have just found out i am pregnant, my job is finishing in 1 month and my 3 year old son has been diagnosed with autism so the reality is bankruptcy but my OH family have offered £7000??? could this be enough for a f&f offer??? prob not but worth a try as the only other option is bankruptcy?? we are with debt free direct - unhelpful is the best word i can say about that!

any advice please???

£7,000 is better than nothing if you want to avoid bankruptcy proceedings. Instruct DFD that this is what you want them to do, and I am sure that Declan will keep a watchful eye on proceedings for you - given that you do not appear to have had great service so far.

thanksfor all the replies!
i am worried sick about this, ive read that if the creditors dont vote then its straight to bankruptcy??? also that they could take the £7000 and srill bankrupt us\???

has anyone known a f&f to be ccepted at the level of £7000 and my circumstances???

As the money will belong to a third party until your offer is accepted, it cannot possibly be retained if the variation is not accepted.

I have often seen offers such as yours accepted and in the circumstances I think it represents a good deal if your funder can afford to give you the funding.

are the voting criteria the same as when your iva gets proposed? what if noone votes etc?? im reding alot on the internet and dont know if im lookig too deep into things!!

Yes - a 75% majority is required and if no-one votes then the variation will not be accepted - but I would be amazed if your IP did not secure at least one vote on the day.
