CCJ Judgement way more then our offer!!

HI, been in a DMP since last July, using vincent bond and all is going well. MBNA were fine with my offer but seem to have sold my debt onto Restons Solicitors (who i have read many bad things about). Anyway they started proceeding with a CCJ, when we asked why they said they wanted to get a charging order on my property. It was pointed out to them that the property was sold a few months back and i now no longer owned any property. They said they would not be able to stop the CCJ.
So i filled in all the paperwork and sent off my stuff from Vincent Bond, with my offer of £54, also sending a copy to the court. I received the judgement today saying that Restons were not happy with the amount i offered and my monthly installments had now been set at £700!!!!. Obviously there is no way i can pay that, i was just wondering if anyone had had a similar experience and managed to get it reduced? I am filling in the N245 form and sending it off.

That's not good! I suggest you speak to your representative at VB to tell them what has happened.

Hi
I think that once you fill out the N245 and enclose your income and expense form, again, you will find that common sense will prevail and a payment level will be set by the judge at, or very close to, the level that you are paying in your DMP.

What a joke. As long as your income and expenditure is honest then the judge will see no point in setting payments at a level you cannot afford as there would be no chance of a successful outcome!!

Wish you the best of luck I am sure the judge will be more reasonable. Personally I hope the judge lowers your payment cause that would serve the creditors right for forcing you down this path unnecessarily.
