A friend of mine has just called round and has been asking some questions in regards to personnel BR. Honest it is a friend as I am happy the way we seem to be heading. His situation is that several years ago he and his wife as a partnership built a small housing development. The hmrc have now came back on him and are looking for a "lot" of money, but do not seem to be pushing him into a corner where they are going to make them BR. His question is what would be the benefits of declaring BR as opposed to them making him BR. The only debt is from that time, and they live in rented accomodation.
I think that the only benefit is a time one. He could petition straight away and probably get a quick Court hearing, whereas HMRC can take ages to get to that stage. If this is the only way out, then the sooner it starts the sooner it finishes - but obviously a clear advantage of waiting for HMRC is that he would not have to pay the £510 required to have his debtor's petition processed.
Thanks Melanie
On a different topic - if you are having a bad day check out "anti depression video" on you tune. If this does not make your day and give you a giggle then nothing will. I am going to see if I can get it as a ringtone.
How much is his debt to HMRC? If it is less than £15,000 and he has less than £50 disposable income a month after normal bills have been paid, and nothing over £300 in assets, he could consider a debt relief order.

I must admit I can't stop thinking of what Mike is going through right now, and his poor daughter. Feel so helpless and just wish there was something - anything - that I could do.
But the clip did make me smile and it shows that the world is not such a bad place most of the time, but that will be no consolation for Mike and his family right now.
