I've now had a call and emails from the complaints team at Pay Plan and I'm now hopeful things will get done. I must say the guy who called me - Adam from the complaints side of things has been very helpful today and he is making sure I have my Completion Certificate by the end of the month, if not sooner.

Thanks!

Generally Pay Plan have been good up until I made my Full & Final offer. Since then I've just been fobbed off and it's been delay after delay! Hopefully it's getting sorted now.

Thanks. I have checked my credit file and I have a CCJ showing as active. This debt was included in my IVA. But this is where it gets confusing, the creditor relating to the CCJ never got back to PayPlan to claim anything! But the debt was included in my IVA and they are bound by the terms of it.

So once I have my completion certificate I will contact the creditor and try to get them to remove it! It will be 6 years old in 10 months and will drop off my file then anyway but I'd rather it not be on there showing as Active for another 10 months if I can help it!

The CCJ will remain for six years unless it was registered after the IVA was approved. Make sure the debt was not secured against your property which would explain why the creditor never submitted a claim.

oh right ok, but should it still be showing as active? It was registered before the IVA was approved.

The debt was not against my property, as I don't have one! It was unsecured credit.

Thanks

The CCJ would still be active as it has not been discharged. When the IVA is completed you could request that the CCJ is marked as satisfied but that is only a guess. Others here may have more experience of credit files.

The IVA doesnt cancel out the CCJ - which will remain for six years after the date of issue. It should drop off after the time

Only time you can satisfy/remove a CCJ - is within the 1st 30 day period - and paying the full amount. Otherwise it will remain active for the full 6 years. You have you apply to the Court and pay
a fee - if you think the CCJ should not be registered against you

What the IVA does is stop the CCJ being enforced.
