Hi Im currently just starting my 4th year on av IVA with Freeman Jones. After the annual review had came through i said I owed them £2851 in extra monies. Seeing i gave them my pay slips and p60 each year this came as a shock. I called Freeman Jones and asked whats going on, after 10 min on the phone this figure was reduced to £1901. I was still not happy about this as it was due to a admin error. The lady then passed me on to another person to which aft another 5 minute my bill was now £5558 to pay. At this point im pulling what i left of my hair out. She claims that the last 3 year they have not received all information for the first 18 months of my plan and now we have they have added up all the out standing money owed. Now statement that where missing i gave to them as bank statements and have gave them all my p60's but this was last year. They have only just come up with this figure and now i only have 2 years left to pay it or it gets extended and the IVA wont close untill its paid. This money is owed for 6 months of work from 2 years ago. In that work i had exspences that i had to pay for but the boss paid me back straight into my account so i have no prove on whats is wages and what is expenditure. ( this could be as much as £2000 ) Due to this Freeman Jones dont care. My point is their was a massive review after 18 months as freeman Jones never came back to me after 12 where i changed from both me and my partner to just me on the IVA, their was a big review and changes and nothing was picked up at this time when the IVA was subjected to massive change. Now 18 months later and they want £5558 extra. Surely its their mistake and should be on the case more considering iv gave them all paperwork and a big change at 18 months. Not sure where i stand now and whether to get the noose and stall out. haveing an IVA for 5 years is bad enough but extending to 7 it would be been cheaper to miss the 1 month payment with the loan companies then get an IVA.
Ask to speak to your IP direct or a senior supervisor.
This scenario happened to me with expenses and I got it resolved all be it with me being self employed and tax rebates,so a different set of circumstances,be firm but calm tell them that YOU pay them to administer your iva and this is not acceptable.
Ask them how they came to the figures and ask for a full breakdown in writing
Today 1st of December 2016 the vultures finally flew away
I acknowledge that they administer your iva but it's your responsibility to provide the information they request. If you have claimed expenses then you should have the receipts to show them.
If all this went off at the correct time and they have done nothing, I understand your frustration! When we hsd to make extra payments, it said in our proposal that we had to inform them and that we had to make the payments. The proposals seem to rarely be written so that it's the company who is at fault!
If you no longer have the supporting receipts, ask work for copies as theywill have been obliged to keep them. Try to make an arrarrangement to overpay each month to get the balance down, hard to do in an iva, been there, but worth it to reduce the balance.
What uou don't want to happen is to be in breach due to not complying with a request for documents and your iva failing.
I would email and ask for a written breakdown so once you have agreed a figure, it's in black and white.
My advice to anyone in an IVA, and I had to do this myself too, is if you earn more than in your I&E any month do the calculation yourself (I had the 10% 50/50 clause) and pay any extra over straight away (My IVA stated it had to be done within 14 days).
That way you don't get any shocks at the year end or end of the IVA. Also keep any emails or documentation relating to it.
As relieved suggests, ask for a written breakdown of their figures on this.
Relieved makes a valid point -- and one which everyone seems to overlook. This is not aimed at anyone here but a general statement, applying to all of us.
An IVA is YOUR IVA, not the IP's. YOU have agreed to carry out whatever terms are in the arrangement, not the IP.
The IP is a Supervisor of a contract between you and your creditors. Yes, he / she has certain duties to carry out, but compliance is your responsibility.
In this instance FJ seems to have made some errors. However, the OP has also not checked the figures either and, it seems, not accounted for monies when received. So six of one and half a dozen of the other.
Hopefully both parties can recognise their parts in this shambles and work together to sort it out as painlessly as possible.
Jason, try to email Steven Hewitt at FJ .. he is great at getting to the bottom of things and sorting them out.
My opinions are merely that .. opinions based on experience. Always seek professional advice.
IVA Completed 23rd July 2013 .... C.C. 10th January 2014
If you work gave you an expenses rebate of £2,000 then surely they have the claim from you with the evidence that they can at least confirm this to your IP for you?
Was it not separately identified on your pay slip?
You need to ask FJ for a full written breakdown of the correct figure. Write to them for this and explain they have given you 3 different figures within 10 minutes, which is a farce. Send your letter by recorded delivery.
If you can challenge the £2k per my suggestion above I suspect this will reduce the figure significantly so you can put a sensible plan in place to pay what is left. The P60's should also support your figures.
