Hi All,
I requested to apply for a Full and Final Offer with my Creditors in January this year.
To date, im still awaiting a creditors meeting date to be arranged. Ive supplied all documents requested by my IVA company and my IVA has been signed off by my IP a few months ago. I chase progress at least once a week and so far am getting nowhere with moving things along.
I had no idea it would take this long to sort out, and I need a resolution as soon as possible. Can anyone advise the next best step with speeding things up.
My company is Payplan.

Hi and welcome,

You should have had a date by now for a creditors meeting - have you had your proposal letter yet? When you do get it then make sure that there is not something in there to do with bankruptcy if you are not successful - get them to take it out.

Send an email directly to your IP rather than deal with a case worker.

Hi Kallis and thanks for the welcome and for the advice.
Yes, thats what I thought, having read posts from people on here who've had creditors meetings within a month, i am dismayed that 3 months later i have nothing.
No I haven't had any proposal letter yet, all im told is theres lots of people applying for full and finals, its all done in chronological order, ive also been told once a date has been submitted creditors then have 28 days to agree, then i have to wait a month to find out if it's been approved. I honestly feel like im going around in circles, theres much going on in my life, and i need this sorting out asap. My IVA is due to finish anyway in March 2017, ive been paying it since 2010 and at this rate it'll be officially finished. Im not sure if il be allowed to email my IP direct, il ask my IVA company tomorrow for his email address, im not even able to get through directly to the variation department which is where our IP approved documents have been waiting to be processed for the last 7 weeks. It's really getting stressful to be honest.

Just keep on pestering them! That's what I did when I did a full and final a few years ago. If you check your record on the Insolvency Register your IP's name will show up with contact details - otherwise tell them you will be making a complaint unless they sort things out for you.

Well yes i think its got to the complaint stage.
Il see if any luck tomorrow with IP direct then proceed with a complaint if no luck.

Definitely threaten them - it took me a while to get them to sort out a full and final date but I got there in the end!!

As long as they have everything they need they have to call the variation meeting within 21 or 28 days (I can't remember off the top of my head - have a look at the proposal terms).

You need to remind them in writing of their duties and insist the meeting is called.

Also there is no reason why you have to wait a month after the meeting to find out the result. The latest they should know the answer is on the day of the meeting or at any adjournment. depending on how and how soon creditors vote they may even know the answer before the meeting...

Hi Lisa, yes apologies, my query may have been duplicated i posted it 3x because I couldn't see it on the forum each time.
Ive just rang Payplan and yet again told the variation department are waiting to produce a circular detailing proposals to the creditors to send to us and sign, noone can tell me when, why or what the delay is other than " it takes time". Then after I recieved the circular and checked it, it then has to be sent to creditors for a date to be set, lord knows how long that will take, it's been since 3rd January now since my initial request to do a full and final offer. Ive told them im on verge of making a complaint, still no joy. It's probably been around 7-8 weeks since they've had all documents needed. I cannot get to speak directly to the variation department just different case officer after different case officer. It seems a ludicrous way to try to make progress with anything. I cant find my IPs direct email from the insolvency register, ive checked twice.
Its so frustrating. I really need it sorting urgently. My son is disabled and starts a new special school in a different borough in a few months, i need to private rent which we all know will be hard enough in a iva and cannot save anything towards it whilst stuck in the iva, I feel like im getting nowhere.!!

When you do get the proposal, check to make sure that they haven't put in anything about your creditors possibly making you bankrupt - they can and will take that out.

Surprised about not being able to find the address from the register. The details are normally on there.
