Hi.
back in March a friend offered to gift a sum for a final settlement fee for my iva.

I sent All the paperwork they requested. Now after 8 months and a lot of calls to them they have wrote to me asking for all the same information ie a new evaluation fee mortgage redemption statement. All the information they request they need within 7 days if they don't receive it they won't carry on with my offer.

What can I do in this situation as I'm pretty annoyed seems like they don't want me to settle early. I'm not sure of the forum rules so I won't publish the company name.

Kind regards.

Under our terms and conditions we must call a meeting within 21 days unless relieved by the court from doing so. 8 months is well outside that time period.

Hi - Do you have evidence they received that paperwork 8 months ago - did you send it recorded/registered delivery or did they ever acknowledge it?

Hi - everything I sent via email they have now apologised to me and said I don't need to send anything else out as they have all my paperwork. I have it all in email to say they have it. And they received all this in March.

Have they explained why no variation has been called?

Surely 8 months on the figures in the paperwork will now need to be updated to ensure your best pffer is submitted ... its terrible you have been treated like this but if it were me I would submit some up-to-date figures

sounds like a complaint might be in order.

Hi there.

Just to follow up on this it's everything again was submitted at the beginning of November and still no movement. Surely this isn't normal. Originally this was offered nearly a year ago. It's like the people dealing with my offer don't want me to settle early.

Thanks.

M

Complain and then complain to the insolvency service.
IVA started March 2011, Completed March 2016 and certificate issued 11 days after final payment. It was not always easy but then some of the best decisions aren't.

Another worrying thing is that I was told that by putting in an offer if it was refused I could be made bankrupt. My circumstances haven't changed and it was refused I could afford to pay as normal. Does this sound right.

Thanks

M

That is a load of bull.

Worse that can happen is you go back to what you are doing now.

Sounds like pay plan.

Refer them to the fine received by Harrington Brooke's for inappropriate delays in communications to creditors.
