I had an IVA which was administered by Clear Debt. Unfortunately due to ill health I was unable to make any payments into it and in july 2015 the IVA failed. At present I have no income except my disability living allowance and no assets. Today at 8.30 AM I received a phone called from Max Recovery enquiring about my present situation. What should I do now? Being severely ill and 71 years old I can't cope with all this.

What a horrible situation you have found yourself in, without knowing the full facts I do wonder why a 71 year old lady with no assets on benefits is doing in an IVA. Look on the internet and get the telephone number of Stepchange and go through your situation with them for advice

You should also contact the CAB as they are independent and should be able to point you towards a debt relief order or bankruptcy.

Oh Dear how awful. It's a shame your IVA couldn't be varied with payments to date instead. Moving on take some advice about your options from Stepchange or CAB per the above or feel free to call me to chat about your situation and I will give you some free guidance.

Hi,

So sorry to hear of your problems. I agree that you should look towards either a DRO or bankruptcy.

You could speak to Andy Davie/Vincent Bond for some free advice and they may be able to point you in the right direction.
