Hi all just wanting a little advice if possible I am currently 35 weeks pregnant and due to pregnancy related issues from about 30 weeks my hours were reduced and lost my enhancement payments ( I work in care so get over time and sleep in payments) according to my IVA my income I could earn was 1072 now for 3 months I earned a average wages of 750 pound which is a shortfall roughly of 350 however our payments stayed the same! I'm just wondering if we would be entailed to any of this money back, (currently in the process of sending in my wage slips for these few months when my wage was different ) or if it's to late as it was already paid in. If they agree to any reduction, which they should do in my opinion, they can build it in as a reduction going forward, rather than refunding any monies already paid.

Check your paperwork, as most arrangements do give the IP the discretion to reduce payments by up to 15%.

Your IP may want to know how you maintained the payments given such a dramatic drop and why are you only advising of the reduction now. If you have had family assistance for example this may answer the query but I doubt if you will get the money back.

As Foggy says there can be reductions going forward but this looks like a large one.

We have literally had to scrimp for example walking where we can do we save on petrol money and going to my parents house for meals, I have spoke to my IVA company and going forward they have said they will look at this from now on as a month to month payment taking my wage and my husbands into account and work out what should be paid in for the month which is a lot better.

Hopeyou get this sorted out quickly and any problems in the future you should immediately contact your IP. IVAs are not supposed to be a form of punishment but I can see you were only trying to do yopur best for your creditors. You should also think of yourselves too especially with a little one on the way.
