I recieved this letter today and I'm happy to sign although I have one query. We now have to agree to instruct DrSp to investigate any mis sold package bank accounts. Whilst I would obviously like my CC I am worried that this will stir up a problem the account the pba was on was a joint account which is in my iva and which drsp claimed ppi from unkown to my ex which she had to contiue to pay her part of the debt of the account separtely as she was not in a iva and did pay of her debt ;recently she tryed to claim of the ppi the account but drsp had claimed which didnt go down well as she couldnt claim it obviously she is going to claim for the PBA on the joint account so how will that affected me does any know what happens if is is already put a claimed in thanks for reading
State clearly that it was a joint account and that therefore reclaiming can only occur with the permission of both parties.

curious how come when drsp claimed the ppi on that account i was the only one signing paperwork it was done through drsp and they only had my permission and i stated it was a joint account and yet they recevied the ppi money and my ex got none its all gone in to my iva
And now you are left with an ex that is not impressed.
DrSp should have understood what is needed as should the bank etc.

Yep cant blame her it was a lot of money. Just spoke to her and she doesnt want to claim the PBa because she said we did benefit from it and we werent every mis sold it.Any way i should have completed my iva 2 years ago but as you are aware the ppi was holding it up until this week but now to receive our clourse as clear debt calls it we need to sign this paper work about drsp investigating the package bank account i personally feel i wasnt mis sold it anyway as i used the benefits loads of time when we had it so iam not sure if i should be signing the paperwork at all what is the best way forward to closeure have had enough now instead of 5 years its been 7
Previous advice on the board is sign but clearly indicate that you do not believe it was missold as you have benefited from it.
Additionally state that the joint account holder has refused permission to attempt to reclaim.

Suzzy – please get in touch with me regarding this as this is not something I have heard of happening previously.
If the account was in joint names then lenders will only pay money to the correct recipient and will not normally allow a claim if it is held in joint names and only one party has signed. If this has occurred then I can look at it and if necessary ensure the funds are correctly split.
Are you quite certain the account/policy was held in joint names and that the money paid into the IVA represents the full claim and not just your share?
If so, do get in touch and it will be resolved.
