We are financing daughter who has a chronic illness. She is in an IVA. Help please.

Hi guys
latest on this, due to her unable to afford the bills when she had to stop work and can only walk very short distances needed her car for Drs and Hospital visits and shopping etc her Uncle paid off the car for her as I could not afford it, they will not pay my debts, but they have said he will not get his either as it was his choice to pay it ,but without her car could not have attended her regular Drs appts which she needs as she is on wolfran and has to be checked every few weeks, so how do we stand legally to claim this payment back at least payment

Does the IVA company really understand how seriously ill your daughter is?
IVA started March 2011, Completed March 2016 and certificate issued 11 days after final payment. It was not always easy but then some of the best decisions aren't.

they have the letters explaining what the situation is, so they know, they also say an £800 electric bill she owes cannot be paid from the equity,so with the deposit for the flat they say is ok and the 2 bills allowed she will have nothing left from it except further debt of the electric bill still owing,

changing the subject completely...is your daughter safe to be driving if her mobility is so poor? And the warfarin should be able to be managed by a district nurse if her health restricts her ability to make it to a clinic. If her health is so poor at present its certainly reasonable to look at whether it can be closed with payments made to date and allow her to move on and concentrate on her health without the iva hanging over all of you. Hopeyou get things sorted out.

yes she is ok driving, when she visits gets out of the car and comes in ( a 20 mtrs walk ) she cannot talk for a till she gets her breath back, the surgeon at Papworth hope this will improve after removal of as many of the masses of clots as he can in the 8 to 10 hour op, he stated he will not be able to remove them all, which are putting a massive stain on the heart, but should make a difference and be able to walk a further than she can now before she has to stop the op is on 25th of this month and she will be in for two weeks that's why we have has to get her in the flat for when she comes out so the family has paid the deposit as the IVA have been holding up the sale as the money has had to go to them to sort out and as the flat is ideally close to us did not want to lose it, she has not paid the IVA since Aug when all this came about and they had a meeting with the creditors to explain the situation as I have said before, and we thought it was finished till the sale restriction came to light as far as we know it could be sorted within the week, we are still paying some of her bills buying her food etc but to the MONEY PLUS IVA that does not count to pay us back, you say we could stop the agreement which was made when she was earning £21,000 pa , but no one tells me how it could be done or what I can do to get any help for reimbursement, and there is no way we as pensioners can afford a lawyer etc

You are unlikely to get any help for reimbursement until your daughter is out of the IVA.

That means she either needs to speak to them about what the next steps are OR you do based on a letter of authority/Lasting Power of Attorney OR you seek help from Citizens Advice etc.

Sorry to be so blunt but this will continue to drag on if you are not careful and damage your health as well as hers.
