i entered an iva in june 2014 along with my partner who is self employed. The business is not going well although it is in a small amount of profit but its not a good income at all. My partner is Maltese and has a daughter and his family in Malta. Just recently we have been talking about moving over there and declaring bankruptcy here in the uk. The main reasons for moving are to do with his daughter and the fact that they miss each other very much. We also have a little boy who is brother to my other half's daughter and we want them to grow up together. Is there anything which would prevent us from declaring bankruptcy in the uk and moving abroad?
You will possibly need to fail the IVA prior to going bankrupt your local court will advise on this but after you are made bankrupt as long as you tell the OR your forwarding address you can live wherever you like
You will need to fail the IVA first. Don't just miss payments and wait for them to fail you though, ask your IP to fail and tell them the reasons why. If you request the failure it takes a lot less time than waiting about for missed payments to result in failure. You are entitled to request failure though.
Thanks to you both for your replies, they are very helpful. If I request my IP to fail do I have to pay the bankruptcy fees which I believe are around 750.00 per person.
