What do I say to creditors prior to my IVA proposal since closing DDs as advised.

hi all,
freeman & jones are sending my proposal out on fri 25th. I've changed bank accounts and closed direct debit as advised. one of my creditors everyday loans keep ringing me I've told them I'm waiting for my new debit card to come through, I've never missed a payment before and the payment is due on the 25th any ideas what to say to them as freeman & jones told me not to say im entering an iva until they have sent the proposal off, and I don't want them ringing my employer as I think they will do.

It will be difficult to avoid creditors for too long. Why do you think they will contact your work?
Your waiting for a new debit card may work for 7-10 days.

Can you talk to your employer about your situation?

Hi Julie.04,

I am currently in the same position of never missing a payment and sent my proposal off on the 18th Oct. My debts are with CC (Barclaycard x2 and Cahoot) and loan from Nationwide. I told them all that I was having cashflow issues, that I had to prioritise payments and my nonsecured payments were sacrificed. I told them I hope to have everything back in line within the next 4-6 weeks and they all were sympathetic and agreed to stop phoning for that period of time.

It seems that the truth stretched a little has worked for me.

hi paul

they have a reputation for ringing people at work so I've been told, I've had 7 phone calls from them in 5 days since I cancelled their direct debit, and the payments not due till fri. I don't want to inform my employ unless I have too. thanks for your reply

thanks for your reply I will be honest and tell them that I'm having money issues, but I don't think everyday loans will be sympathetic, after the amount of phone calls I've had and the payments not even due till fri.

I am rather surprised that your IP has not contacted creditors in advance of issuing the proposals. Is there any particular reason for this, or the advice you have been provided in not telling your creditors of your intentions?

I unplugged my phone until the iva was set up and running.

they advised me not to tell um yet until they send the proposal, as my wages will be going in my old account on the 25th ,they said to not tell the creditors until I take my wages out as one of my creditors is my bank and they don't want them taking any money out.

Definitely hold-fire until after your wages have cleared.

However, as soon as all your DD's / standing orders are all set up from your new account, just be honest and tell your creditors that you are in the process of proposing an IVA. Give them the contact details of F&J and your IVA reference number. Most creditors will (if my experience was anything to go by), put your account on hold for 30 days.

I am sure your IVA Company has written to each of your creditors, or will be soon, but it often takes several weeks to filter down to the debt-chasing telephone minions (many of whom wont know what an IVA is).

You have my sympathy - I remember this stage well, and the uncertainty of everything is stressful. But you are with a decent IVA firm, and I am sure your IVA will go through.

Surely one of the first bits of advice they should have given you was to change your bank account? The company you are using have their own in-house bank accounts, so am not sure why this was not set up for you at the outset of the proceedings. If you haven't already taken steps to open a new account with a non-creditor bank - I would urge you to do this as soon as possible.
