IVA and go back to debt management. Really fed up with the company i am with. Contradict themselves after every phone call. I am in dispute with them and asked for the recordings of the phone calls that have been made between them and us. Really think now that i could handle this myself better. What are the repocussions of me failing my IVA.

IVA final payment left the bank on the 26th January 2013...looking forward to a debt free future.

never spoke to my IP. Only advisers, Now we are in contact with think money complaints dept. Who have told me today that there have been failings on there behalf and have reviewed phone calls over the past year. I am awaiting the cd's of these calls as i am taking the matter further.

Hi Skyline. On the assumption that you cannot find a way forward with your current company the IVA will be allowed to fail, at which time your creditors will add back lost interest and possible late payment charges.

I doubt, after failing the IVA, they will be sympathetic to a DMP -- but you never know.

How far are you into this IVA ? You could always start another with a different company, or consider bankruptcy.

At a push, depending upon the severity of your current firms failings you could petition the court to transfer your IVA to another IP --- this is a REAL long shot though and far from straightforward (and could be expensive).

foggy -there a too many to list, but basically "told one thing - then they say another. Example (1) Yes your wife can take a 2nd job, she is allowed to make £271 a month before we put the extra into the iva. 10 months later after reviewing pay slips which averaged £317 a month. They take £178 a month extra on top of what were paying in allready. When i questioned this they denied they said it. Example (2) my wife gets mileage for her 2nd job. Told by advisor we could still claim for petrol even though she was getting it back. Then 10 months later - we are accused of claiming for it when we should not have, even though we questioned this aswell - the reply from advisor was "even though your getting it back, i would still claim. Made us feel like we were trying to cheat them. And it goes on!!

Yes, I see what you mean. If you continue the IVA with them I would conduct future correspondence by email or letter (even with an email get written confirmation of anything important). Hopefully they can come to a sensible solution having reviewed the calls.

I personally conducted all our communicatin with our IP in writing by email....when i did call i then followed it up with an immediate email to confirm telephone stating date and time and who ..... Never left anything to verbal only .....

Stay strong skyline. Year 2 and 3 was the most difficult for me. If yr ip is not available speak to yr supervisor. Put yr view across and see if you can compromise . It's worth a go. You have started yr debt free world so make the most of it, keep strong x

i know its easy for us to say stick with it when we dont have the stress you have currently; however i would suggest the fact that they have said there have been failings on their part, may hopefully see them want to make amends

i would follow the advice above however and email them , as you then clearly have both a record and timeline for future reference

good luck and really try and keep calm , count to 10 and try and get through it,,as i suspect a DMP may only bring stress of another kind and in effect only be a short term solution to the debt that will possibly increase if you fail your IVA

Freeman Jones have a couple of representatives who post on the forum primarily to pick up client complaints. If this matter is currently being dealt with by the complaints department, it is probably better that you let that process run its course. I doubt a DMP is a better option for you than the current IVA, but why not speak to them about this to understand the implications of exiting the IVA - this could mean you would be jumping from the frying pan into the fire.

I'm sorry to hear that you remain unhappy with our final response to your complaint.

There are a number of factors which have all been taken into consideration including our inability to confirm your monthly expenses.

We do not wish to see any IVA fail, especially as you head towards the latter stages of you arrangement.

If you are able to provide evidence of all the income received and all your expenses then I'm confident that we can resolve this and help you to conclude your IVA.

The letter you've received does highlight how to take this further should you wish to do so, however I would also add that we are happy to discuss things with you at any point and help you with the remaining term of your arrangement.

I&E has been sent as requested for 1st review in January! This is when we were accused of lying about petrol expenses after one of your colleagues told us we could claim for petrol, regardless of the fact my wife got it back from work.
Have so far received No final response, spoke to Helen 2 days ago and this letter will not be sent until next week. As she is awaiting your IT department to put telephone calls onto disc and sent to me.

It seems that your complaint is being processed, and now Steven is on the case I am sure that this can be resolved to everyone's satisfaction. Let's hope for a sensible outcome for all concerned.
