Evening all, I have come tonight to a letter from a deby collector for my M and S credit card which says if I don't contact them soon they will send someone to my house. But they are now closed and am not sure they will be there on bank holiday Monday. So should I ring the card people direct or wait and speak to the debt company.
I am still in discussion about setting up an IVA and hope to finally open a new bank account this week. So need a breathing space as I am feeling emotionally wrecked. If is only just 5 weeks since my mum died and things are still hard. So any advise please would be most welcome.

The card people probably won't discuss this now, having instructed a debt collector. Ring the collector on Tuesday ( no harm in trying tomorrow or Monday, they work odd hours)and explain that you are entering an IVA and give them your IP's details. At the same time ring your IP to let them know, in case they have to step in.

If it is a debt collector just ignore them and continue with setting up the IVA. A debt collector has no more power than me or you. All they can do is call you, write to you or visit your home. They have no pwers whatsoever...

If it is a bailiff and they turn up do not let them in just politely tell them you are setting up an IVA and to go back and discuss it with M&S. They will probably try and bully you but just stand your ground and ignore them. They will not waste their time if their is no fee in it for them.

Whatever you do don't panic or fall for their pressure tactics.

If you get really concerned with a bailiff at the door just call the Police..

Sorry to hear that you are having a tough time, the early days are the hardest, stick it out, once your IVA is accepted it all goes quiet, its bliss!!!

It is unlikely that a debt collector does turn up but if one does tell him to leave your property or you will call the police. They have no legal standing and if you have any problems with them at all you are entitled to use whatever force is necessary to remove them from your property.

As the Others have said they have no powers of entry or to seize goods
They have no legal right to enter your home and wedging the door open with a foot to stop you shutting it is considered to be forced entry and you should call the police.
There are many who once you tell them about the IVA will go back to thier client for advice but there are still some who try to be silly tell them to go away in whatever language you choose and shut the door on them if they do so.

IVA final payment left the bank on the 26th January 2013...looking forward to a debt free future.
