Hi my friend was in an IVA which finished 2 years ago. Today she got a phone call from a company who claim to be working with her IP (Debt free direct) and they told her that she is able to claim back the vat on the fees she paid.
Does she get to keep this money as her IVA is finalised?
My IVA finished in October last year and I have had my certificate of completion. Would I also be eligible to claim back my VAT.
Can you please advise if this is possible and how to go about it.

As a result of the Paymex VAT decision, it was determined that (despite an earlier confirmation from HMRC that all IP services were to be standard rated) that VAT should actually not have been charged on Nominee and Supervisor funds.
IPs have had to submit repayment claims to HMRC and most of us have now received the money and repatriated it back to the creditors who suffered the ultimate loss in paying the VAT in the first place. I struggle to see how your friend can be entitled to a VAT refund in their own right, and would be interested to know more about what she has been advised if possible.
What if that particular IP is of the opinion that post IVA PPI claim goes back to the claimant as a few do, (not that I know what DFD postion is on PPI) then any VAT would also travel the same route?
I have just looked at another post in respect to PPI claim post IVA and it appears what the posters interpretation of DFD position is that it indeed is returned to the claimant, in which case that would make sense in respect to the VAT to this post.
Also I note a comment that the FOS position of PPI claim is also to be returned to the claimant if this be the case (see post philipsmith) and turns out to be a ruling by FOS then I don’t dare ask what the consequences may be…
