Can nursery fees be included in the IVA ?

My friend is in an IVA but she also owes outstanding Nursery Fees and is being pursued to pay the entire amount. Are Nursery Fees exempt or can they be included in the IVA?

i would say yes can be included

If the friend is already in an IVA as the post indicates then she needs to speak to the IP to see if this can be included.

Hi Matthew. Were these arrears at the nursery acquired after your friend entered the IVA? If, so they might not be allowed to be included.

If they were before then they should have been included.

Now, there is a possibilty, assuming they occurred after entering the IVA, that your IP might allow them to be included. However, this will jeopardise your friends use of the nursery in the future. It might be better to ask for a break in payments to cover the arrears.

But, in any event, this has to be discussed with the IP to find a solution.

is this for a nursery the child no longer attends ? I would say it depends if the child is still going there? Are they still paying some where else ? do they get tax credits ,can they make seperate arrangement with nursery ?

Either way the IP has to be informed as the OP would need to be able to get an allowance to pay the fees outside of the IVA if this was the case.
