my IVA company was reported to over charge customers and it was reported and they were fined heavily by the regulators and as a result company went into liquidation, they sold the clients to the other partner of the firm and all IVA supervisor's account details changed, I keep on paying into old account, which was bumping back... suddenly I got a letter that I am in arrears and then default notice and then IVA failure notice....I wrote to the regulatory body about this and the very heavy charges, which they are now investigating the matter but they told me to start another IVA, which is costing me Nominee fee again and supervisor fee ( £ 5,000), also I started receiving letters from creditors and also letter from the court (creditors going into court)no body is telling me, what happened to my 27 x £750 installments, i have already paid?, WHY i HAVE TO GO THROUGH ANOTHER 5 years of fresh IVA? is their any body looking into the IVA supervisor's malpractices, shall I hire a solicitor, who is going to pay for thr solicitor? Is this not a frank bullying? lots of other questions......
I cant give any advice but i really feel for you. This is a a disgrace but i thought once you went into a IVA it was covered by a court of law.Anybody who had some common sense can see that you have done nothing wrong. Get a solicitor and take it all the way and good luck.
I would also be keen to know which firm you are with and also which regulatory body you have been advised by. I don't think it is the place of a regulatory body to be giving you any sort of debt advice - so perhaps there may be some confusion along the way?

ACCA has taken over my case
the query was very very high charges for a personal IVA and the abrupt unilateral declaration of IVA failure, turning down to meet me one to one, there was no change in my circumstances, the company changed accounts and the bosses, and i pai regularly in the old account and arrears developed and they ruthlessly failed the IVA, they have not distributed a peeny of my money to the creditors......
and what will happen to my monies , I paid to that IV company , nearly 27-28000 pounds in 33 monthly installments (£750/month)
how I can retrieve my money back or make it part of new IVA.....??

ACCA is the regulatory body dealing with the IVA company, first I wrote to IP regulatory body, who said my firm is under ACCA, and they directed my application to ACCA , who has accepted this and appointed a senior investigation officer for that last month.
and what is CAB stand for and any address please?

Citizens Advice Bureau - they are free to use (publicly funded) and have offices in most towns. They will be listed in your local phone directory. Hope you get a resolution, good luck.
