Im with GT and have just received a call from a PPI company who claim to be working on behalf of GT to instigate PPI claims on my behalf. Ive told them im not interested in claiming as dont beleive i took out protection...BUT can GT force me to push this issue? Majority of my debt were in joint names and run up by my ex wife as part of the affair she was having so it will get very complex if i was to even attempt a PPI claim.
I have court orders stipulating various financial matters rubber stamped by the courts so i do not want all that brought back up..
Any thoughts? Is any part of my life personal anymore?!
In a word no! Sticks to your guns don’t be bullied. To make matters worse over a 1000 cases a day are being referred to FOS for investigation, which is now liked a blocked sink, so you can expect to wait at least a year if your case is referred to them.
I think it’s just come of a time when PPI claims have become untenable, in time constraints if nothing else.
I’m sure there are a few IP’s looking to resolve the issue, but until then a big just say no banner thingy campaign
My personal advice would be to comply with the request for authority to identify whether you did take out any PPI. This will demonstrate your willingness to co-operate with your IP in an attempt to maximise realisations, and if it is seen that any successful PPI claim was not an asset of your IVA then it will be your money to keep.
If the PPI is on joint loans, then any compensation will be split equally between your wife and yourself, assuming that the creditors do not apply set-off.
Guidance is likely to be issued to IPs by their regulators shortly on this matter - but it will be clear that debtor co-operation is required and expected, so long as the request is reasonable.
Hi
Basically send the forms off with a covering letter saying you dont think you were sold PPI however feel free to look into it
That way you are being pro active
PPI is mis sold at many levels even if you said yes its mis sold as from what I have read its not going to pay out and also you are supposed to be told its interest based and would you like to go elsewhere and get a cheaper insurance etc they just make you feel obliged to say yes ok Or sometimes its slipped under a different name or charge Let them have a look you will be surprised what they can recover I know my friend has had a repsonse to some finance on a car loan and been told they have found £1000 in charges so far and he didnt sign any PPI so there you go
That is very good advice Donkeyass - especially where you recount about the way some of these policies have traditionally been mis-sold by banks historically.
Hey Geoff, sorry hope some of the above has helped.
GT did send paper work out to clients months ago regarding PPI claims then a few weeks later they sent some more out regarding unfair charges on credit cards etc. They basically said if we don't hear from you then it was giving them permission to go ahead. I phoned in & said I knew of one PPI on my Loan which I agreed to & wanted at the time. The credit card charges I've no idea on now if I was unfairly charged etc, so I agreed for it to be looked into.
The only thing that threw me was they basically said I had to be actively trying to get as much back for my creditors in the arrangement, so I said go ahead to all of it, personally I've nothing to lose, the PPI can't be claimed as it wasn't miss sold and I've no idea if they can get back anything in unfair charges as I didn't default till I entered a IVA. As long as their not going to bother me as I'm busy enough as it is! They can find out for themselves.
Final IVA payment made in April 2013, never ever thought we could do it or get through it but we did! X
