What does a couple with joint IVA and joint mortgage in negative equity have to when they separate?

My daughter and her husband have a joint IVA and a joint mortgage which is in negative equity.If they separate what do they have to do ?

Only your own IP can give proper advice as we have very few details but it may be possible to split the IVAs and carry on individually. If both or either of you cannot maintain an I A then that party will need to look at other options.

There may be no need to disturb the IVA if they both afford to make contributions to the payments to equal the payment they are currently making - howevet if one of them is going to move out of the property they will probably be incurring more costs. The best thing to do is to work out their individual income and expenditure summaries - assuming the separation is going to happen - and then they should take advice from the IP acting for them both.

Try not to worry as this does happen a lot, and in most cases IPs are able to find some workable solution for their clients.
