Hi I am currently in an IVA with my husband. I am on maternity leave however want to return to work part time as I do not feel I will be able to cope with 2 children working full time. Can my IP stop me from doing this? Our payments have risen since the IVA was agreed due to my promotion at work. I believe that we will be able to make roughly the same payment as we did when it was first agreed would they find this acceptable. (it may be slightly less than first agreed).

Thats sounds perfectly reasonable and your IP cannot force you out to work and indeed should have the descretion to reduce the paymenst to what they were originally. If they need reduced further it may require another meeting of creditors but I foresee no problem when they will still get a higher dividend than was originally offered.

Hi Becky, I was in same situation as you, I was in an IVA with my husband before going on maternity leave and then went back to work part-time. I informed my IP of my plan to go back part-time and of course at reduced wages and they were fine about it, they held a variation meeting and the new lower payments were accepted but I had to add on a few months to the end of my 5-year IVA making it 5 years 4 months.... then a couple of years later I had another baby so had to add on another 6 months to the end making it 6 years in the IVA.
IVA CC received 6th Sept 2012
