I think he means that if you personally chose to make a claim through a claims company and the money claimed was deemed to have gone into the IVA then you would be liable to pay the claims company out of your own pocket.

ie: claims company claimed £10000, all of this money goes into the IVA, claims company work on 30% commision which leaves you with a bill of £3000 to pay out of your own money.

thanks @stormsylv - I understand what you have said there, but maybe my original question was mis-understood. I have claimed - 3 years after my IVA was successfully completed, and I have received 17K and although it is very unclear as to the exact legal ruling, if that money is subsequently deemed to be included in the IVA, because it was my decision to claim and because I DIDNT use a claims company, then would it be reasonable for me to keep a proportion of the refund because I did the work to reclaim the money for the Creditors and didn't use a claims company? Maybe 5% less than the cut the average claims company would have taken?

And another point - I claimed after the IVA was completed and there was no mention of PPI in my IVA agreement or was it ever mentioned by my IP. In fact the PPI storm was only just gathering pace when my IVA finished. But these days it seems from other posts on this forum, that IP's are almost forcing people to claim during the IVA and in some cases are not issuing the COC until they have. In people's experience, are IP's advising people to use claims companies for these claims or to do it themselves - if they are advising claims companies, surely they are de facto recommending reducing the dividend to the creditors because of the claims company fees?
